LOI SUR LES TERRES DES TERRITOIRES DU NORD-OUEST LAND WITHDRAWAL ORDER (SOUTHWESTERN PORTION OF DEHCHO REGION) DÉCRET D’INALIÉNABILITÉ DES TERRES (PARTIE SUD-OUEST DE LA RÉGION DE DEHCHO)

WHEREAS the Government of the Northwest Territories may withdraw from disposal certain tracts of territorial lands in order to facilitate the conclusion of Aboriginal land and resource agreements; The Commissioner in Executive Council, under paragraph 19(

a) of the Northwest Territories Lands Act and every enabling power, orders as follows: Attendu que le gouvernement des Territoires du Nord-Ouest peut déclarer inaliénables certaines parcelles territoriales en vue de faciliter la conclusion d’ententes relatives aux terres et aux ressources autochtones; le commissaire en Conseil exécutif, en vertu de l’alinéa 19a) de la

Loi sur les terres des Territoires du Nord-Ouest et de tout pouvoir habilitant, décrète : 1.

(1) Subject to subsection (2) and sections 2 and 3, the surface and subsurface rights to the tracts of territorial land set out in the

Schedule are withdrawn from disposal. 1.

(1) Sous réserve du paragraphe (2) et des articles 2 et 3, les droits de surface et les droits d’exploitation du sous-sol des parcelles territoriales décrites à l’annexe sont soustraits à l’aliénation.

(2) The surface rights to the territorial lands situated within the municipal boundary of the Hamlet of Fort Liard, as described in the Hamlet of Fort Liard Continuation Order, made under the Hamlets Act, are excluded from the withdrawal.

(2) Les droits de surface des parcelles territoriales situées à l’intérieur des limites municipales du hameau de Fort Liard, tel que décrit dans l’Arrêté portant prorogation du hameau de Fort Liard, pris en vertu de la

Loi sur les hameaux, sont exclus de la soustraction à l’aliénation.

Section 1 does not apply to the disposition of (

a) substances or materials under the Quarrying Regulations; (

b) interests in land listed in the Acquisition Agreement, dated May 5, 1988 between Her Majesty the Queen in right of Canada and the Government of the Northwest Territories, the Northern Canada Power Commission and the Northwest Territories Power Corporation; or (

c) interests in land related to infrastructure projects. 2. L’article 1 ne s’applique pas à l’aliénation :

a) des matières ou matériaux prévus par le Règlement sur l’exploitation de carrières;

b) des titres sur les terres visées par l’entente d’acquisition, datée du 5 mai 1988, conclue entre Sa Majesté la Reine du chef du Canada et le gouvernement des Territoires du Nord-Ouest, la Commission d’énergie du Nord canadien et la Société d’énergie des Territoires du Nord-Ouest;

c) des titres sur les terres liés aux projets d’infrastructure. 3. For greater certainty,

section 1 does not apply to (

a) the locating of a mineral claim by the holder of a prospecting permit that was granted before the day on which this order comes into effect; (

b) the recording of a mineral claim that is referred to in paragraph (

a) or that was located before the day on which this order comes into effect; (

c) the granting of a lease under the Mining Regulations to a person with a recorded 3. Il est entendu que l’article 1 ne s’applique pas à ce qui suit :

a) la localisation d’un claim minier par le titulaire d’un permis de prospection délivré avant la date à laquelle le présent décret entre en vigueur;

b) l’enregistrement d’un claim minier visé à l’alinéa a) ou localisé avant la date à laquelle le présent décret entre en vigueur;

c) l’octroi, en vertu du Règlement sur l’exploitation minière, d’un bail au 1

claim, if the lease covers an area in the recorded claim; (

d) the issuance of a significant discovery licence under the Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this order comes into effect, if the significant discovery licence covers an area that is subject to the exploration licence; (

e) the issuance of a production licence under the Petroleum Resources Act to a holder of a significant discovery licence that is referred to in paragraph (d), if the production licence covers an area that is subject to the significant discovery licence; (

f) the issuance of a production licence under the Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this order comes into effect, if the production licence covers an area that is subject to the exploration licence or the significant discovery licence; (

g) the issuance of a surface lease under the Northwest Territories Lands Act to a holder of a recorded claim under the Mining Regulations or of an interest under the Petroleum Resources Act, if the surface lease is required to allow the holder to exercise rights under the claim or interest; or (

f) l’octroi, en vertu de la

Loi sur les hydrocarbures, d’une licence de production au titulaire d’un permis de prospection ou d’une attestation de découverte importante délivré avant la date à laquelle le présent décret entre en vigueur, si le périmètre visé par la licence de production est également visé par le permis ou par l’attestation;

g) l’octroi, en vertu de la

Loi sur les terres des Territoires du Nord-Ouest, d’un bail pour la surface au détenteur d’un claim enregistré visé par le Règlement sur l’exploitation minière ou au titulaire d’un

titre visé par la

Loi sur les hydrocarbures, si ce bail est exigé pour l’exercice des droits qui sont conférés par le claim ou par le titre;

h) le renouvellement d’un titre. 4. This order is repealed on December 31, 2028. R-120-2024,s.2. 4. Le présent décret est abrogé le 31 décembre 2028. R-120-2024, art. 2. 2
