LOI SUR LES PROCURATIONS The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows: Le commissaire des Territoires du Nord-Ouest, sur l’avis et avec le consentement de l’Assemblée législative, édicte :

INTERPRETATION AND APPLICATION DÉFINITIONS ET CHAMP D’APPLICATION

Definitions 1. In this Act, "attorney" means a person authorized to act for a donor under a power of attorney; (mandataire) "Court" means the Supreme Court of the Northwest Territories; (Cour) "declaration" means a declaration provided for in subsection 7(2); (déclaration) "donor" means an individual who gives a power of attorney; (mandant) "enduring power of attorney" means a power of attorney provided for in

section 11; (procuration durable) "mental incapacity" means the inability of a person, by himself or herself or with assistance, to (

a) understand information that is relevant to making a decision concerning his or her financial affairs, or (

b) appreciate the reasonably foreseeable consequences of a decision concerning his or her financial affairs or the lack of such a decision; (incapacité mentale) "nearest relative" means, with respect to a donor, (

a) the living and mentally capable relative of the donor who is the adult relative first listed in the following subparagraphs and the eldest of two or more relatives of the same category: (

i) spouse, (ii) child, (iii) parent, (iv) sibling, (

v) grandparent, (vi) grandchild, (vii) parent’s sibling, (viii) sibling’s child; and (

a) to whom a donor or attorney is married, or (

b) with whom a donor or attorney is living in a conjugal relationship outside marriage, if the person and the donor or attorney (

(1) Subject to this section, this Act applies to a power of attorney executed before or after this Act comes into force, despite any agreement or waiver to the contrary. 2.

(2) A power of attorney executed before the coming into force of this Act that provides that it comes into force at a specified future date or on the occurrence of a specified contingency is deemed (

a) to be valid on the coming into force of this Act, if (

i) the specified future date or contingency occurs before that time, (ii) the attorney is an adult and is not mentally incapacitated or an undischarged bankrupt on the coming into force of this Act, and (iii) notwithstanding any conflict with sections 6 and 17, the power of attorney would otherwise be valid as a springing power of attorney if executed after the coming into force of this Act; or (

b) to be valid on the specified future date or on the occurrence of the specified contingency, if (

i) the specified future date or

Validity of existing enduring powers of attorney

(3) A power of attorney executed before the coming into force of this Act that provides that it is to continue notwithstanding any mental incapacity of the donor that occurs after the execution of the power of attorney is deemed (

a) to continue and to be valid on the coming into force of this Act, if (

i) the donor becomes mentally incapacitated before the coming into force of this Act, (ii) the attorney is an adult and is not mentally incapacitated or an undischarged bankrupt on the coming into force of this Act, and (iii) notwithstanding any conflict with sections 6 and 17, the power of attorney would otherwise continue and be valid as an enduring power of attorney if executed after the coming into force of this Act; or (

b) to continue and to be valid on the mental incapacity of the donor, if (

i) the donor becomes mentally incapacitated after the coming into force of this Act, (ii) the attorney is an adult and is not mentally incapacitated or an undischarged bankrupt on the mental incapacity of the donor, and (iii) notwithstanding any conflict with sections 6 and 17, the power of attorney would otherwise continue and be valid as an enduring power of attorney if executed after the coming into force of this Act.

(3) La procuration signée avant l’entrée en vigueur de la présente loi, dans laquelle il est prévu qu’elle demeure en vigueur malgré l’incapacité mentale du mandant survenue après cette signature est réputée :

b) non éteinte et valide au moment où l’incapacité mentale du mandant survient si les conditions suivantes sont réunies : (

i) la survenance de l’incapacité mentale du mandant est postérieure à l’entrée en vigueur de cette loi, (ii) le mandataire, au moment de l’entrée en vigueur de la loi, est un adulte qui n’est pas atteint d’incapacité mentale ni n’est un failli non libéré, (iii) malgré les articles 6 et 17, la procuration demeurerait en vigueur Validité d’une procuration durable existante 5

(4) For greater certainty, subsections (2) and (3) do not apply to validate any actions taken before the coming into force of this Act under a power of attorney referred to in those subsections.

(5) Section 13.1, and the restriction in

section 6 in respect of the spouse of an attorney, do not apply in respect of a power of attorney executed before the coming into force of this Act. SNWT 2002,c.20, s.13(2).

a) that purports to be a general power of attorney, or (

b) that grants a scope of authority similar to that which an attorney has under paragraph 14(1)(a), shall not be construed as being limited by or to any specific powers that are expressly included in the power of attorney. (1) Where the authority of an attorney under a power of attorney is terminated or is found, by the Court, to be invalid, any subsequent action taken under the power of attorney by the attorney is valid and binding in favour of any person, including the attorney, who did not know, and had no reasonable grounds to believe, that the attorney’s authority had been terminated or found to be invalid. 4.

(2) Where the authority of an attorney under a power of attorney is terminated or is found, by the Court, to be invalid, the attorney is not liable to the donor or the estate of the donor for subsequently acting under the power of attorney if the attorney did not know, and had no reasonable grounds to believe, that the attorney’s authority had been terminated or found to be invalid.

(1) In this section, "purchaser" means a purchaser in good faith for valuable consideration and includes a lessee, mortgagee and any other person who, for valuable consideration, acquires an interest in property or a lien or charge upon property. 5.

(2) Where a power of attorney is given for valuable consideration and is expressed in the document creating the power to be irrevocable, then, in respect of a purchaser, (

a) the donor may not terminate the power of attorney without the agreement of the attorney, and the power of attorney is not terminated by the death, mental incapacity or bankruptcy of the donor; and (

b) the attorney and the purchaser are not affected by any act done by the donor to terminate the power of attorney without the agreement of the attorney, or by the death, mental incapacity or bankruptcy of the donor.

(5) Notwithstanding any statutory or other restriction relating to the disclosure of information, if the power of attorney provides that it comes into force on the mental incapacity of the donor, information respecting the donor’s health may be disclosed to the extent necessary for a declarant, a medical practitioner, a psychologist or the Court to determine whether the specified contingency has occurred.

(1) Where an attorney appointed under a springing power of attorney mistakenly but reasonably believes in good faith that the date or contingency specified in the power of attorney has or has not occurred, the attorney is not for that reason alone liable for acting or failing to act under the power of attorney. 10.

(1) A power of attorney is valid as a springing or enduring power of attorney if the donor is an adult at the time he or she executes the power of attorney and the power of attorney (

a) is in writing; (

b) is dated; (

d) is signed by the witness in the presence of the donor; and (

e) provides, as the case may be, (

i) that it is to come into force at a specified future date or on the occurrence of a specified contingency, or (ii) that it is to continue in force notwithstanding any mental incapacity of the donor that occurs after its execution. 13.

(2) Notwithstanding paragraph (1)(c), where a donor is incapable of reading or signing a springing or enduring power of attorney, an individual other than the attorney or the attorney’s spouse may sign the power of attorney on the donor’s behalf in the presence and at the direction of the donor, in which case (

a) the donor shall acknowledge the signature in the presence of a witness; and (

b) the witness shall sign the springing or enduring power of attorney in the presence of the donor.

(3) A springing or enduring power of attorney may not be validly given by a donor if, at the time the power of attorney is executed, the donor is mentally incapable of understanding the nature and effect of the document in general or any of the following related matters in particular: (

a) the nature of the donor’s property that will be subject to the power of attorney and its approximate value; (

b) the donor’s obligations to his or her dependants; (

c) that the attorney will, under the power of attorney and subject to its provisions, be able to do on the donor’s behalf anything in respect of the donor’s property that the donor could do if mentally capable, except make a will; (

d) that the attorney must account for his or her dealings with the donor’s property; (

e) that the power of attorney may be subsequently revoked by the donor, if he or she is mentally capable of doing so; (

f) that the donor’s property that will be subject to the power of attorney may decline in value unless the property is prudently managed by the attorney; (

g) that the attorney may possibly misuse the authority given to him or her under the power of attorney.

(4) For greater certainty, subsection 29(2) of the Land Titles Act applies to the witness to the execution of a power of attorney if the donor or the attorney wishes to file the power of attorney in a land titles office.

b) may exercise the attorney’s authority for the maintenance, education, benefit and advancement of the donor’s spouse and dependent children, including the attorney if he or she is the donor’s spouse or dependent child. 14.

c) a declaration that a power of attorney is invalid or terminated; (

d) an order removing the attorney appointed under the power of attorney; (

e) an order requiring the attorney to provide an accounting to the Court; 26.
