LOI SUR LES TERRES DES TERRITOIRES DU NORD-OUEST LAND WITHDRAWAL ORDER (CENTRAL AND EASTERN PORTION OF THE SOUTH SLAVE REGION) DÉCRET D’INALIÉNABILITÉ DES TERRES (PARTIES DU CENTRE ET DE L’EST DE LA RÉGION DE SOUTH SLAVE)

WHEREAS the Government of the Northwest Territories may withdraw from disposal certain tracts of territorial lands in order to facilitate the conclusion of an Aboriginal rights agreements; Attendu : que le gouvernement des Territoires du Nord-Ouest peut déclarer inaliénables certaines parcelles territoriales pour faciliter la conclusion d’ententes relatives aux droits ancestraux; AND

WHEREAS the Government of the Northwest Territories wishes to facilitate the conclusion of an agreement between Black Lake First Nation, Fond Du Lac First Nation, Hatchet Lake First Nation, Nñh hoghedi Kóe and Her Majesty the Queen in Right of Canada; que le gouvernement des Territoires du Nord-Ouest souhaite faciliter la conclusion d’une entente entre la Première nation de Black Lake, la Première nation de Fond Du Lac, la Première nation de Hatchet Lake, l’organisation Nñh hoghedi Kóe et Sa Majesté la Reine du chef du Canada, The Commissioner in Executive Council, under paragraph 19(

a) of the Northwest Territories Lands Act and every enabling power, orders as follows: la commissaire en Conseil exécutif, en vertu de l’alinéa 19a) de la

section 2, the surface and subsurface rights to those parcels of land identified as Lots AD-001 to AD-084, Plan 4781, filed in the Land Titles Office on January 7, 2021, are withdrawn from disposal.

Sous réserve de l’article 2, sont déclarés inaliénables les droits de surface et les droits d’exploitation du sous-sol des parcelles désignées comme les lots AD-001 à AD-084, plan 4781, lequel a été déposé au Bureau des titres de biens-fonds le janvier 2021. 2. For greater certainty,

section does not apply to (

a) the locating of a mineral claim by the holder of a prospecting permit granted before June 1, 2017; (

b) t h e r e c o r d i n g o f a m i n e r a l c l a i m t h a t i s referred to in a paragraph (

a) or that was located before June 1, 2017; (

c) the granting of a lease under the Mining Regulations to a person with a recorded claim, if the lease covers an area in the recorded claim; (

d) the issuance of a significant discovery licence under the Petroleum Resources Act to a holder of an exploration licence that was issued before June 1, 2017, if the significant discovery licence covers an area that is subject to the exploration licence; (

e) the issuance of a production licence under the Petroleum Resources Act to a holder of a significant discovery licence that is referred to in paragraph (d), if the 2. Il est entendu que l’article ne s’applique pas à ce qui suit :

e) l’octroi, en vertu de la

Loi sur les hydrocarbures , d’une licence de production licence covers an area that is subject to the significant discovery licence; (

f) the issuance of a production licence under the Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before June 1, 2017, if the production licence covers an area that is subject to the exploration licence or the significant discovery licence; (

g) the issuance of a surface lease under the Northwest Territories Lands Act to a holder of a recorded claim under the Mining Regulations or of an interest under the Petroleum Resources Act , if the surface lease is required to allow the holder to exercise rights under the claim or interest; or (

titre visé par la

Loi sur les hydrocarbures, si ce bail est exigé pour l’exercice des droits qui sont conférés par le claim ou par le titre;

h) le renouvellement d’un titre. 3. This order is repealed on the day before the Effective Date of the agreement between Black Lake First Nation, Fond Du Lac First Nation, Hatchet Lake First Nation, Nñh hoghedi Kóe and Her Majesty the Queen in Right of Canada. 3. Le présent décret est abrogé la veille de la date d’entrée en vigueur de l’entente entre la Première nation de Black Lake, la Première nation de Fond Du Lac, la Première nation de Hatchet Lake, l’organisation Nñh hoghedi Kóe et Sa Majesté la Reine du chef du Canada. 4.
