Definitions Définitions 1(1) In this Act “corporation” includes a company and any body corporate, regardless of where or how it is incorporated; « personne morale » “government corporation” means a corporation that is expressly declared by or under this Act or another enactment to be an agent of the Government of the Yukon, and includes a wholly - owned subsidiary of a governm ent corporation; « personne morale du gouvernement » “wholly -owned subsidiary” means a corporation that is wholly owned directly by one or more government corporations or indirectly through one or more subsidiaries each of which is wholly owned directly or indirectly by one or more government corporations, but does not include the Yukon Energy Corporation; « filiale en propriété exclusive ». 1(1) Les définitions qui suivent s’appliquent à la présente loi.

b) all the directors of the corporation, other than ex officio directors, are appointed by the Commissioner in Executive Council or a Minister; (

c) all the directors of the corporation are appointed by a government corporation; or (

(3) For greater certainty, the following corporations and their wholly -owned subsidiaries are government corporations (

a) Yukon Housing Corporation; (

b) Yukon Liquor Corporation; and (

c) Yukon Development Corporation.

Part 1

b) Ministers must be accountable to the Legislative Assembly for what government corporations do; (

c) each government corporation and its officers and staff must be accountable through a Minister to the Legislative Assembly for what the government corpo ration does; (

d) it is important that the work of government corporations be co -ordinated with the work of other departments of the government; and (

e) co -ordination will be facilitated by establishing long -term relationships and understandings between a c orporation and a department whose responsibilities are similar and by each having a common Minister who can ensure that the department and corporation have, and carry out, a common understanding of how to co -ordinate their policies and program delivery.

(2) Subject to a directive under subsection (1), the Minister and the government corporation shall negotiate annually a protocol about performance expectations for the corporation to meet and roles of the Minister, board, and president, respectively, in the work of the corporation; the protocol becomes effective when agreed to by the Minister and the corporation.

(3) Subsection (1) does not autho rise a directive, and subsection (2) does not authorise a protocol, about how the board should dispose of an application or an appeal about the issuing, cancelling, or suspending of a licence or a permit, if that application or appeal was made before the d irective was issued.

(4) The board, the president and other officers, and the staff of the corporation shall comply with and implement any directive under subsection (1) and any protocol under subsection (2).

(5) Compliance by the corporation with a di rective under subsection (1) and a protocol under subsection (2) is deemed to be in the best interests of the corporation. ”

LOI SUR LES PROFESSIONS DENTAIRES (sanctionnée le 30 mai 2002) The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, en acts as follows: Le Commissaire du territoire du Yukon, sur l'avis et avec le consentement de l'Assemblée législative, édicte ce qui suit : 1 This Act amends the Dental Profession Act . 1 La présente loi modifie la

Loi sur les professions dentaires . 2 Sections 24, 25, and 26 of the Act are repealed and the following sections are substituted for them “24(1) Subject to subsection (2), no dental hygienist shall perform any of the dental services set out in

section 25 with respect to any patient unles s a dentist licensed pursuant to this Act has first examined the patient and has authorised, in writing, a specific treatment to be performed by the dental hygienist for that patient.

(2) Any dental hygienist registered pursuant to

section 23 may, in the case of an emergency and where no professional dental advice or assistance is available, provide to a patient any of the dental services set out in

section 25 that he or she normally would perform under the direction of a dentist without authorisation of a specific treatment for the patient by a dentist. 2 Les articles 24, 25 et 26 de la même loi sont abrogés et remplacés par ce qui suit : « 24.

(2) A dental hygienist may administer local anaesthetic solutions by infiltration and mandibular bl ock methods, or such other method as the Commissioner in Executive Council prescribes, if authorisation to do so has been endorsed on their registration under subsection (3).

(3) If satisfied that a dental hygienist is adequately qualified to administer local anaesthetic by infiltration and mandibular block methods, or another prescribed method, the Registrar may endorse on the dental hygienist’s registration a stipulation authorising the dental hygienist to administer local anaesthetic by the method they are qualified for, s ubject to such conditions as the Registrar thinks necessary.

e) administering local anaesthetic solutions by infiltration and mandibular block methods or such other methods as the Commissioner in Executive Council prescribes; (

f) placing restorations in deciduous and permanent teeth; (

g) performing vital pulpotomies for deciduous teeth; (

h) performing uncomplicated extractions of deciduous and permanent teeth; (

i) placing sutur es; (

j) taking dental impressions for study casts; (

k) performing or providing such other dental services, subject to such conditions, as the Commissioner in Executive Council prescribes.

(3) A dental therapist shall perform a dental service listed in paragraphs (2)(

d) to (k), only if (

a) within the preceding two years, a dentist has examined the patient and supplied the dental therapist with a treatment plan for the patient based on that examination and the dental therapist performs only dental services that (

i) are specified in or consistent with the treatment plan, or (ii) differ f rom the treatment plan only because clinical or radiographic indications warranting a change are found during the interval between examinations by a dentist; or (

b) the most recent examination by a dentist was more than two years previous and there are cli nical or radiographic indications that the delay to arrange an examination by a dentist would harm the patient.

(2) Section 28 of the Act is amended by adding the following subsection to it “

section 24, 25, or 26 commits an offence and is liable on

summary conviction to a fine of up to $1,000 or to imprisonment for a term of up to one month, or to both fine and imprisonment. ”

d) the cost of delivering each primary responsibility; (

e) the linkages with the consolidated accountability plan and the accountability plans of other departments, if any; (

f) the performance measures to be used to assess the department’s performance in meeting its goals; (

g) the targets set by the departments for each of the performance measures; and (

h) a comp arison of the actual performance results to date with targets set in previous departmental accountability plans, if any.
