CHAPTER 1 ORDINANCES OF YUKON TERRITORY 1953 (First Session) AN ORDINANCE TO AMEND THE "GASOLINE AND DIESEL OIL TAX ORDINANCE" (Assented 10 April 21, 19.53.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1.

Section fifteen of the "Gasoline and Diesel Oil Tax Ordinance" being

chapter three of the Ordinances of the Yukon Territory, 1949 (second session), as enacted by

Chapter three of the Ordinances of the Yukon Territory, 1950 (second session), is hereby amended by inserting immediately after paragraph (

c) the following paragraph: "(

CHAPTER 2 ORDINANCES OF YUKON TERRITORY 1953. (First Session) AN ORDINANCE TO AMEND THE "GOVERNMENT LIQUOR ORDINANCE" (Assented to April 21, 1953.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1. Subsection one (

a) of

section twenty-five of the "Govern ment Liquor Ordinance" being

chapter fourteen of the Ordinances of the Yukon Territory, 1952 (first session), as enacted by

chapter two of. the said Ordinances, 1952 (second session), is hereby repealed.

PUBLIC SERVICE ORDINANCE

CHAPTER 3 ORDINANCES OF YUKON TERRITORY 1953 (First Session) AN ORDINANCE TO AMEND "THE YUKON TERRITORIAL PUBLIC SERVICE ORDINANCE" 3 (Assented to April 21, 1953.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the 'said Territory, enacts as follows: 1.

(1) Section thirty-eight of "The Yukon Territorial Pub lic Service Ordinance", being

chapter seventy-six of the Consolidated Ordinances of the Yukon Territory, 1914, as amended by

chapter one of the Ordinances of the Yukon Territory, 1952 (second session), is hereby amended by striking; out the words "subject to such additional compensation as the Commissioner may authorize".

(2) Section thirty-eight is further amended by adding thereto the following subsection: "

(2) The Commissioner shall have the power to make regulations regarding overtime work of Territorial Government employees, and payment of additional compensation there for."

THE HOSPITALS ORDINANCE

CHAPTER 5 ORDINANCES OF YUKON TERRITORY 1953 (First ,Session) AN ORDINANCE TO AMEND "THE HOSPITALS ORDINANCE" 5 (Assented to April 21, 1953.) The' Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1.

Section four of "The Hospitals Ordinance" being

chapter forty-three of the Consolidated Ordinances of the Yukon Territory, 1914, as amended by

chapter four of the Ordin ances of the Yukon Territory, 1952 (second session), 1S repealed and the following substituted there for : "4.

(1) Subject to subsection two, out of the monies appropriated by the Commissioner in Council for the purpose of this Ordinance in any fiscal year, there may be paid by the Commissioner in that fiscal year to every hospital complying with the' provisions of this Ordinance and all orders made by the Commissioner hereunder the fol lowing: (

a) Not mor~ than two dollars for each day's actual treatment and stay therein of each patient. (

b) In addition to the amount provided under (

a) not more than five dollars for each day's actual treatment and stay of each free bed patient, and not more than three dollars for each day's actual treatment and stay for every free ambulant patient. Grants to Hospitals

c) In addition to the amount provided under (

a) not more than five dollars for each day's actual treatment and stay of every partially free patient during the calendar year for which said aid is granted, less the number of days represented by any money's worth received for such treat ment from or on behalf of the patient. (

d) One-half the regular fee charged by the hospital for medicines, x-rays, operating room and similar fees, other than ward fees, for every free patient admitted to or being within the hospital.

(2) No aid shall be granted in respect of any partially free patient until there has been filed with the Territorial Treasurer in respect of such patient a certificate of the attending physician that each day of such treatment and stay was necessary, and an application on behalf of the hospital for such aid with evidence which satisfies the Territorial Treasurer that the hospital has made every reason able effort to collect from such patient the full cost in money's worth of his treatment and stay and stating the reasons why such full cost could not be collected and the amount which was so collected. 2. The Ordinance is deemed to have come into force on the first day of April, 1952.

MUNICIPAL ORDINANCE 7

CHAPTER 6 ORDINANCES OF YUKON TERRITORY 1953 (First Session) AN ORDINANCE TO AMEND THE "MUNICIPAL ORDINANCE" -. (Assented to April 21, 1953.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1. The "Municipal Ordinance", being

chapter eight of the Ordinances of the Yukon Territory, 1949 (second ses sion), is hereby amended by inserting immediately after subsection sixty-seven of

section one hundred and seventy-two the following subsection: "(67

A) Subject to the assent of a majority of the rate payers who vote on the ratification of the by law entering into a contract with a person or persons undertaking to provide the residents of the municipality with electric light, electric power, natural gas, water and telephone services within the municipality and to outside points, and for the conferring of a special franchise upon that person or persons in respect of the subject matter of the contract for any period not in excess of twenty years with a provision for renewal for further terms of ten years each." CHAPTER 7 ORDINANCES OF YUKON TERRITORY 1953 (First Session) AN ORDINANCE TO AMEND THE "MOTOR VEHICLES ORDINANCE" (Assented to April 21, 19.53.) The Commissioner of the Yukon Territory, by and with the advice and consent of the' Council bf the said Territory, enacts as follows: 1.

Section twelve of the "Motor Vehicles Ordinance",

chapter eight cif the Ordinances of the Yukon Territory, 1952 (first session), is amended, (

a) by deleting the word "plate" where the same ap pears in subsection one and substituting therefor the word "plates"; (

b) by deleting the word "plate" wherever the same appears in subsection two and substituting there for the word "plates"; and (

c) by repealing subsection three and substituting therefor the following: "

(3) Every motor vehicle other than motorcycles or pedal bicycles with motor attachment, shall have two number plates firmly affixed to the motor vehicle, one plate at the front of the vehicle and one plate at the rear of the vehicle." 2.

Section thirteen of the said Ordinance is repealed and the following

section is substituted there for : "13. If the number plates or one of the number plates of a registered motor vehicle or trailer are lost

MOTOR VEHICLES ORDINANCE 9 or destroyed or are so defaced as to be illegible, the owner shall forthwith apply to the Commis sioner, or to a person authorized by the Commis sioner, for a re-registration of his motor vehicle or trailer and shall accompany with his application the following: (

a) the permit issued to him under

section ten; (

b) the remaining or qefaced number plate, if any; (

c) an affidavit showing that the original plates or one of them have been lost or destroyed; and (

d) payment of a fee of two dollars; and the Commissioner, or person authorized by him, may re-register the motor vehicle or trailer and issue to the owner a new permit and new number plates." 3.

Section sixteen of the said Ordinance is hereby amended by adding the following subsections: "

(4) The Commissioner may issue, without fee, to a dealer "In Transit" markers which shall be used only on the original trip of new motor vehicles from the distributor to the dealer.

(5) An "In Transit" marker shall he pasted on the wind shield of the motor vehicle and shall be destroyed immediately upon the arrival of the vehicle at the dealer's place of business.

(6) Every dealer shall account to the Commissioner for all "In Transit" markers issued to him." 4~ The said Ordinance is further amended by inserting im mediately after

section sixteen the following section: In transit markers

Visitillg forces vehicles ellemptioll 10 MOTOR VEHICLES ORDINANCE "16A The provisions of this Ordinance regarding the registration and licensing of motor vehicles shall not apply to the service vehicles of a visiting force as defined by the Visiting Forces (North Atlantic Treaty) Act of Canada nor shall any tax be pay able in respect of the use of said vehicles on the roads." S.

Section nineteen of the said Ordinance is amended, (

a) by deleting the words "Subject to subsections two and three" where they occur in subsection one and substituting there for the words "Subject to sub sections two, three and four", and (

b) by adding thereto the following subsection: "

(4) Subsection one does not apply to a member of a visiting force as defined in the Visiting Forces (North Atlantic Treaty) Act of Canada, if such member is in possession of a driving permit or license issued to him by such force."

STEAM BoILERS ORDINANCE

CHAPTER 8 ORDINANCES OF YUKON TERRITORY 1953 (First Session) AN ORDINANCE TO AMEND THE "STEAM BOILERS ORDINANCE" 11 (Assented to April 21, 1953.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1.

Section eight of the "Steam Boilers Ordinance", being

chapter two of the Ordinances of the Yukon Territory, 1952 (first session), as enacted by

chapter nine of the Ordinances of the Yukon Territory, 1952 (second session), is amended by striking out the word and letters "B and C" where they appear in the last line of subsection one thereof, and substituting therefor the word and letters "B or e". 2.

Section -twenty of the said Ordinance, as amended by

chapter nine of the Ordinances of the Yukon Territory, 1952 (sec,ond session), is further amended by repealing subsection two thereof, and substituting therefor the following subsections: "

(2) Subject to subsection three the Commissioner, upon payment of the proper fee as shown in the

schedule hereto, shall by certificate designate the class of persons entitled to take charge of a boiler or pres sure vessel under this section.

Section 8 amended- Boiler certificate

(3) The Commissioner may, upon recommendation of Provisional certificate the Inspector, issue a provisional certificate to any person who has been employed as a fireman on a boiler for not less than one year upon payment of a fee of ten dollars; such provisional certificate to be valid for a period o-f not less than one year."

Section thirty-five of the said Ordinance, as enacted by

chapter nine of the Ordinances of the Yukon Territory, 1952 (second session), is repealed and the following sub stituted therefor: "35

(1) Where any boiler is delivered to a purchaser within the Territory, an affidavit of the fore man under whose supervision the boiler was built, fully filled out and detailed in accordance with a form prescribed by the Province or State where the boiler was built, shall be forwarded to the Commissioner. Such form shall show the name and address of the purchaser which may be filled in by the agent making the sale.

(2) The inspector wi\l not be required to examine or finally pass new boilers if the provisions of this

Section have been complied with.

(3) The same inspection procedure and the same fees used in connection with steam boilers shall be applicable to hot water boilers used for heating purposes and having more than one hundred and fifty square feet of heating surface.

(4) The Canadian Regulations for the Construc tion and Inspection of Boilers and Pressure Vessels published by the Canadian Standards Association at Ottawa shall govern the design, construction and inspection of boilers and pres sure vessels in all respects where not covered by the regulations."

WORKMEN'S COMPENSATION ORDINANCE 13

CHAPTER 9 ORDINANCES OF YUKON TERRITORY 1953 (First Session) AN ORDINANCE TO AMEND THE "WORKMEN'S COMPENSATION ORDINANCE" (Assented to April 21, 1953.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1. Paragraph (

k) of

section two of the "Workmen's Com pensation Ordinance" being

chapter twelve of the Ordin ances of the Yukon Territory, 1952 (second session), is amended by adding immediately at the end thereof the following words: "and includes Lloyds of London as registered in the Province of British Columbia." 2.

(1) Subsection four of

section sixteen of the said Ordin ance is repealed and the following substituted there for: "

(4) Subject to subsection five, where an accident happens to a workman in the course of his employment in such circumstances as en titled him or his legal personal representative or his dependents to an action against some person other than his employer or another workman of his employer, the workman or his legal personal representative or his de pendents may bring such action.

(2) Section sixteen of the said Ordinance is further amended by repealing subsection seven and substi tuting therefor the following: Paragra{lh (

(7) Any amount received by the employer from such other person in excess of the cost of the accident to the employer shall be paid over to the injured workman or his legal personal representatives or his dependents, as the case may be, upon the employer receiving from such injured workman or his legal personal representative, or his dependents, as the case may be, a release from any further claim upon the employer in respect of the accident for or on account of which payment was or is being received, in which case the workman or his legal personal representatives or his dependents, as the case may be, is not there after entitled to receive from or be paid by the employer or the insurer any further com pensation or medical aid for or in respect of injury or death arising out of such accident." 3.

Section forty-two of the said Ordinance is repealed and the following substituted therefor: "42

(1) Each· employer who is not exempt from the operation of subsection one of

section three shall pay to the Commissioner or such other person as the Commissioner may designate at the time the employer pays the premium on any insurance policy entered into by him pur suant to this Ordinance, an assessment of such percentage of his estimated payroll for the current calendar year not exceeding one-half of one per cent. of such payroll as the Com missionermay from time to time designate by regulation.

(2) If the assessment paid by an employer under subsection one. is greater or less than the amount that he would have paid had the assessment been made on his actual payroll for the calendar year, he is, if he has paid more; entitled to a refund or credit· of the amount of the assessment on his actual pay roll, or, if he has paid less, he shall pay to the

WORKMEN'S COMPENSATION ORDINANCE 15 . Commissioner the am·ount of such difference immediately after he ceases to be an employer under this Ordinance, or upon the termina tion of such year, whichever is the sooner.

(3) Each employer exempted from the application of subsection one of

section three shall pay to the Commissioner at the time the exemption . is granted an assessment in an amount equivalent to such percentage of his estimated payroll for the current calendar year not ex ceeding one-quarter of one per cent. of such payroll as the Commissioner may designate by regulation.

(4) If the assessment paid by an employer under subsection three is greater or less than the amount he would have paid had the assess ment been made on his actual payroll for the current calendar year, he is, if he has paid more, entitled to a refund or credit of the amount of the difference between the amount paid and the amount of the assessment on his actual payroll, or, if he has paid less, he shall pay to the Commissioner the amount of such difference immediately after he ceases to be exempt from subsection one of

section three, or upon the termination of such year, which ever is the sooner:

(5) From and out of· the Yukon Consolidated Revenue Fund, there may be paid the referee's fees and expenses, the sum to which an em ployer is entitled to be refunded under this

section and such other costs incidental to the administration arid enforcement of this Ordin ance." Payments from Yukon Consolidated Revenue Funrl

Section 2 amended 16 THE YUKON GAME ORDINANCE

CHAPTER 10 ORDINANCES OF YUKON TERRITORY 1953 (First Session) AN ORDINANCE TO AMEND "THE YUKON GAME ORDINANCE" (Assented to April 21, 1953.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:- 1. "The Yukon Game Ordinance" being

chapter eleven oi the Ordinances of the Yukon Territory, 1951 (second session), is amended by striking out the words "and Publicity" where the same appear in paragraph (

d) of

section two thereof. Sub"ction 2 2.

section 4 amended

(1) Paragraph (

a) of subsection two of

section four of the said Ordinance is amended by adding to the words "no open season throughout year" the fol lowing words: Polar bear hunting season Hunting and trapping permits 3. "subject to subsection four".

(2) Section four is further amended by adding thereto the following subsection: "

(4) Notwithstanding anything herein contained, Eskimos may hunt polar bear from the 1st day of October until the 31st day of May next following, both dates inclusive."

Section five of the said Ordinance is hereby repealed and the following substituted there for : "5. No person shall engage in hunting or trapping any game permitted to be taken under

section four of this Ordinance unless he is the holder of a valid

THE YUKON GAME ORDINANCE 17 and subsisting license or permit issued pursuant to this Ordinance, bearing his signature or duly wit nessed mark on the face thereof, and no person shall be entitled to register a trapline unless trap ping is one of his main .occupations." 4.

Section six of the said Ordinance is amended by adding ExemplioD thereto the foIlowing after paragraph (k): 5. "( 1) Resident over the age of seventy years Free" Paragraph (

b) of subsection one of

section eight of the said Ordinance is amended by striking out the words "one caribou and one grizzly bear" where they appear at the end thereof and substituting therefor the foIlowing: "One caribou, one grizzly bear, and either one black bear or one brown bear" 6. Subsection one of

section nine A of the said Ordinance, as enacted by

section five,

chapter thirteen of the Ordin ances of the Yukon Territory, 1952 (first session), is hereby repealed and the foIlowing substituted therefor: "A

(1) Every guide in charge of a hunting party shall observe and comply with the following duties and requirements: (

a) He shaIl, on his return from a big game hunting trip with a party for which he has been engaged as a guide, make a re turn in writing on a form prescribed by .the Commissioner· giving: (

i) particulars concerning the district in which the trip was undertaken; (ii) the name, address and licence num ber of each member of the party; (iii) the place of departure and return; (iv) the method of transportation em ployed; 5eclioD 8 ammded- Duties of guide

v) particulars of each species of game killed or taken by each member of the party; and (vi) particulars of any violations of this Ordinance by any member of the party. . (

b) He shall, if he can do so without using force, prevent any person, for whom he is acting as a guide, from hunting or killing any game in excess of the bag limit set out in this Ordinance· or Regulations made hereunder; (

c) He shall not, while he is guiding a person or party engaged in big game hunting, kill, take or catch any game." 7. Subsection one of

section nineteen of the said Ordinance is repealed and the following substituted therefor: Expiration date of licensfs

(1) All non-·resident big game and bird licences shall expire on the thirtieth day. of November in each year, and all other licences issued under the provisions of this Ordinance shall expire on the thirtieth day of June next fol lowing the year of issue of such licences."

chapter six of the Ordinances of the Yukon Territory, 1945, any ten or more persons who desire to associate themselves together for the purpose of protecting children from cruelty, ameliorat ing family conditions that lead to neglect of children and caring for and protecting children in need of protection, may make application to the Commissioner in Council; and

WHEREAS application for incorporation has been made in the form prescribed by the provisions of the said Ordinance; and

WHEREAS it is expedient to grant this request; THEREFORE, the Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1. 2. Charles Roderick MacNevin, Frederick Dore Locke, Sylvia Jean MacNevin, Geneva Jensen, Alma Hamil ton, Doris Gentleman, Almas David Vars, Florence Gertrude Vars, Marporie Ethel Locke, and Harold Kelba, all of the City of Whitehorse in Yukon Terri tory, constitute a body corporate under the name of "The Children's Aid Society of Southern Yukon." (2) Notwithstanding subsection one, a municipal ity shall, subject to the prior approval of the Commissioner, have the power to make a by-law changing the date of its financial year from the 31st day of March to the 31st day of December."

WHEREAS, it appears by message from Wilfrid George Brown, Esquire, Commissioner of the Yukon Territory, and in the estimates accompanying the same, that the sums hereinafter mentioned in

Schedule "A" to this Ordinance are required to defray certain expenses of the Public Service of the Yukon Territory and for the purposes relating thereto, for the twelve months ending March 31, 1954. The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows: 1.

From and out of the sums at the disposal of the Yukon Council there shall be paid and applied a further sum not exceeding in the whole two hundred and fifty-nine thousand five hundred and thirty-three dollars and thirty cents for defraying the several charges and expenses of the Public Services of the Yukon Territory and for the twelve months ending March 31, 1954, as set forth in

Schedule "A" of this Ordinance. 2. The due application of all monies expended shall be duly accounted for.
