EMPLOYMENT STANDARDS (FLEXIBLE AVERAGING AGREEMENTS)

AMENDMENT REGULATION

section 138 of the Employment Standards Code.

1 The Employment Standards Regulation (AR 14/97) is

amended by this Regulation.

Section 13.2(

c) and (

d) are repealed.

3 Sections 13.4 to 13.48 are repealed.

4 The following is added before the heading to

Part 3:

Transitional

13.49(1) This

section provides for the transitional application of the

repeal of

section 13.2(

c) and (

d) and sections 13.4 to 13.48.

(2) In this section, "flexible averaging agreement" means an

averaging agreement entered into under

section 13.4(1) (repealed)

before this

section comes into force.

(3) A flexible averaging agreement that is in effect when this

section

comes into force remains valid until the earliest of the following:

(

a) the date the flexible averaging agreement is cancelled;

(

b) in the case of a flexible averaging agreement made as part of

a collective agreement, the date a subsequent collective

agreement is entered into;

(c) 2 years after the date this

section comes into force.

(4) An agreement under

section 13.45(1) (repealed) entered into by

the parties to a flexible averaging agreement that is in effect when

this

section comes into force remains valid until the earliest of the

following:

(

a) the date the agreement or the flexible averaging agreement is

cancelled;

(

b) in the case of an agreement entered into by the parties to a

flexible averaging agreement made as part of a collective

agreement, the date a subsequent collective agreement is

entered into;

(c) 2 years after the date this

section comes into force.

(5) Section 13.2(

c) and (

d) and sections 13.4 to 13.48 continue to

apply with respect to

(

a) a flexible averaging agreement that remains valid under

subsection (3), and

(

b) an agreement under

section 13.45(1) (repealed) that remains

valid under subsection (4).

5 This Regulation comes into force on September 1, 2019.

EMPLOYMENT STANDARDS (LOOKOUT OBSERVERS)

AMENDMENT REGULATION

on July 18, 2019 pursuant to

section 138 of the Employment Standards Code.

1 The Employment Standards Regulation is amended by

this Regulation.

2 The following is added after

section 1.1:

Lookout observer exemptions

1.2(1) In this section, "lookout observer" means an employee

stationed at a wildfire lookout site whose primary responsibilities are

(

a) provide early detection of smoke and fires,

(

b) report smoke, fire and lightning observations, and

(

c) monitor and record observed smoke and fires.

(2) Section 14(1)(a) (relating to the keeping of employment records

for regular and overtime hours of work),

section 16 (relating to hours

of work),

section 19 (relating to days of rest) and

Part 2, Division 4

(relating to overtime and overtime pay) of the Act do not apply to a

lookout observer or to the lookout observer's employer while acting in

the capacity of employer.

TEACHERS' AND PRIVATE SCHOOL TEACHERS' PENSION PLANS

(CONTRIBUTION RATES) AMENDMENT REGULATION

April 18, 2019 pursuant to

section 16(2) of the Teachers' Pension Plans Act.

1 The Teachers' and Private School Teachers' Pension

Plans (AR 203/1995) is amended by this Regulation.

Schedule 1 is amended

(

a) in

section 10(2)(

a) by striking out "7.40%" and

substituting "7.87%";

(

b) in

section 10(2)(

b) by striking out "11.75%" and

substituting "12.22%";

(

c) in

section 11 by striking out "2.77%" and

substituting "2.30%";

(

d) in

section 13(

a) by striking out "8.68%" and

substituting "9.12%";

(

e) in

section 13(

b) by striking out "2.61%" and

substituting "2.17%".

Schedule 2 is amended

(

a) in

section 10(a)

(

i) by striking out "8.36%" and substituting "8.76%";

(ii) by striking out "7.40%" and substituting "7.87%";

(

b) in

section 10(b)

(

i) by striking out "12.12%" and substituting

"12.52%";

(ii) by striking out "11.75%" and substituting

"12.22%";

(

c) in

section 11 by striking out "0.40%" and

substituting "0.00%";

(

d) in

section 13(

a) by striking out "9.34%" and

substituting "9.73%";

(

e) in

section 13(

b) by striking out "0.39%" and

substituting "0.00%".

4 This Regulation comes into force on September 1, 2019.
