An Act to Amend the Gasoline and Motive Fuel Tax Act Loi modifiant la Loi de la taxe sur l’essence et les carburants Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1 The Gasoline and Motive Fuel Tax Act,

chapter G-3 of the Revised Statutes, 1973, is amended by adding after

section 7 the following: 1 La Loi de la taxe sur l’essence et les carburants, cha- pitre G-3 des Lois révisées de 1973, est modifiée par l’ad- jonction de ce qui suit après l’article 7 : LOSSES OF GASOLINE AND MOTIVE FUEL PERTES D’ESSENCE ET DE CARBURANT 7.01(1) Every collector shall justify and establish to the satisfaction of the Minister any claim made by the collector for the loss of gasoline or motive fuel. 7.01(1) Tout percepteur justifie et établit d’une façon jugée satisfaisante par le Ministre la réclamation qu’il pré- sente pour la perte d’essence ou de carburant. 7.01(2) Every collector who has excess unverifiable losses of gasoline or motive fuel, calculated in accordance with the regulations, shall pay a penalty, when assessed therefor by the Minister, equal to the amount of the tax that would have been collectable by the collector if the quantity of gasoline or motive fuel that exceeds the threshold pre- scribed by regulation for an unverifiable loss had been sold to a consumer liable to pay the tax under this Act. 7.01(2) Tout percepteur qui subit des pertes invérifia- bles excédentaires d’essence ou de carburant calculées conformément aux règlements d’application paie une pé- nalité, lorsque le Ministre établit une cotisation à cet effet, égale au montant de la taxe qui aurait été percevable par le percepteur si la quantité d’essence ou de carburant qui dépasse le seuil réglementaire au

titre d’une perte invéri- fiable avait été vendue à un consommateur assujetti à la taxe en vertu de la présente loi. 7.01(3) The Minister is not bound by any return or in- formation provided by the collector to verify losses of gasoline or motive fuel and may, despite any return or in- formation delivered or if no return or information has been delivered, assess the penalty payable under this section. 7.01(3) Le Ministre n’est pas lié par une déclaration ou par des renseignements que fournit le percepteur pour vé- rifier les pertes d’essence ou de carburant et peut établir une cotisation à l’égard de la pénalité à payer en vertu du présent article, qu’une déclaration ou des renseignements lui aient été remis ou non. 1

7.01(4) If an assessment or reassessment was done be- tween January 1, 1997, and the date of the enactment of this section, inclusive, pertaining to the tax payable on ex- cess unverifiable losses of gasoline or motive fuel, the tax so determined shall be deemed to be the penalty payable under subsection (2) and, unless collected by the Province before the date of the enactment of this section, is due and payable immediately to the Province by the person subject to the assessment or reassessment despite any judgment to the contrary, whether the judgment is obtained before, on or after the enactment of this section. 7.01(4) Si une cotisation ou une nouvelle cotisation a été établie entre le 1 er janvier 1997 et la date d’édiction du présent

article ou à la date de son édiction. 7.01(5) If any amount of the tax referred to in subsection (4) was collected by the Province, the amount shall by this

section be conclusively deemed to have been collected and retained by the Province, without compensation, as pay- ment for the penalty despite any judgment obtained by any person for recovery of the amount, whether the judgment is obtained before, on or after the enactment of this section. 7.01(5) Si la province a perçu tout montant de la taxe visée au paragraphe (4), ce montant est par le présent ar- ticle définitivement réputé avoir été perçu et retenu par la province, sans indemnisation, à

article ou à la date de son édiction. 7.01(6) The Taxpayer Protection Act does not apply to the penalty referred to in this section. 7.01(6) La

Section 45 of the Act is amended 2 L’article 45 de la Loi est modifié (

a) in subsection (2) by adding after paragraph (

d) the following:

a) au paragraphe (2), par l’adjonction de ce qui suit après l’alinéa d) : (d.01) prescribing one or more methods for calculat- ing unverifiable losses and excess unverifiable losses for the purposes of

section 7.01 and prescribing one or more thresholds for the purposes of that section; d.01) prescrivant une ou plusieurs méthodes de calcul des pertes invérifiables et des pertes invérifiables ex- cédentaires pour l’application de l’article 7.01 et un ou plusieurs seuils pour l’application de cet article; (

b) by adding after subsection (2) the following:

chapter R-10.22 of the Acts of New Brunswick, 1983, is amended in the definition “tax” by adding “the penalty referred to in

section 7.01 of the Gasoline and Motive Fuel Tax Act” before “and all deposits made”. 3 L’article 1 de la
