Section 16 of the Senior Citizens’ Financial Aid Act The Governor in Council on the report and recommendation of the Minister of Community Services dated May 2, 2000, pursuant to

Section 16 of

Chapter 419 of the Revised Statutes of Nova Scotia, 1989, the Senior Citizens’ Financial Aid Act, is pleased to amend the Senior Citizens’ Financial Aid Regulations made by Order in Council 82-785 dated June 29, 1982, in the manner set forth in

Schedule “A” attached to and forming part of the report and recommendation, effective on, from and after June 8, 2000.

Schedule “A” Amendment to the Senior Citizens’ Financial Aid Regulations made by the Governor in Council pursuant to

Section 16 of

Chapter 419 of the Revised Statutes of Nova Scotia, 1989, the Senior Citizens’ Financial Aid Act The Senior Citizens’ Financial Aid Regulations made by the Governor in Council by Order in Council 82-785 dated June 29, 1982, are amended by repealing subsection 13(2) and substituting the following subsection:

(2) The rebate paid pursuant to subsection (1) shall be determined as follows: (

a) for an applicant who completed a property tax rebate application prior to December 31, 1999, and received a property tax rebate in respect of property taxes paid in 1998, the rebate to be paid in the year 2000 and subsequent years shall be 50% of the actual property taxes paid in the rebate year or $400.00, whichever is the lesser; (

b) for an applicant who does not meet the requirements of clause (a), the rebate to be paid in respect of property taxes paid in 1999 and in subsequent rebate years shall be (i) $70.00 in the year 2000, (ii) $85.00 in the year 2001, (iii) $100.00 in the year 2002, (iv) 50% of the actual property taxes paid in the rebate year or $400.00, whichever is the lesser, in the year 2003 and subsequent years. 457

Schedule “A” Amendments to the Regulations made Pursuant to

Section 20 of

Chapter 131 of the Revised Statutes of Nova Scotia, 1989, the Dispensing Opticians Act The regulations made by the Board of Dispensing Opticians and approved by the Governor in Council by Order in Council 70-940 dated October 6, 1970, are amended by (

a) adding “and includes a contact lens student” after “Register” in subsection IV(1); and (

b) adding the following subsections immediately after subsection IV(5): (5A) Despite subsection (5), an approved dispensing optician who is registered in the Special Register pursuant to subsection III(2) as a duly licensed certified contact lens fitter may sponsor 1 additional student optician, where that student optician is a contact lens student. (5B) Prior to a dispensing optician being approved by the Board as a sponsor, the dispensing optician must complete the forms prescribed by the Board for this purpose. 460

d) of the Health Authorities Act 1 In these regulations, (a) “Act” means the Health Authorities Act; (b) “CHB” means a community health board established or continued pursuant to the Act; (c) “DHA” means a district health authority as defined in the Act; (d) “health district” means a health district established pursuant to the Act; (e) “board of directors” means the board of directors of a DHA. 461

Part II Regulations 2( 1 ) A nomination committee for each DHA shall be established to include the Chair or designate of each CHB in the health district, including the Chair or designate of each CHB that is partly included in the health district.

(2) The nomination committee can expand its membership as it sees fit, provided the membership of the committee continues to provide for equitable representation of each CHB in the health district. 3 The role of the nomination committee is to (

a) establish or approve a process that is open, public, and transparent and consistent with these regulations by which the number of nominees required by the Minister are selected by the CHBs of the health district; (

b) subject to the Act and these regulations and in particular, to the need for broad representation of communities within the health district on the board of directors, allocate to each CHB of the health district a share of the nominations to the board of directors to be made by the CHBs of the health district; (

c) where the number of nominees selected by the CHBs of the health district is less than the number required by the Minister, select the number of additional nominees required by the Minister; (

d) ensure that the nominations made under (

a) and (

c) are forwarded to the Minister for consideration within the time frame required by the Minister. 4 Where the nomination committee is required to select additional nominees pursuant to

Section 3, the committee may make the required selections or adopt such process for further CHB or public input as the nomination committee sees fit, provided it satisfies the “open, public, and transparent process” requirement and these regulations. 5 The process used by a CHB or the nomination committee for a health district for selecting nominees for appointment to a board of directors shall be open, public, and transparent in all respects, including (

a) subject to restrictions on eligibility found in the Act, the opportunity to be considered for nomination must be open to all members of the public; (

b) the opportunity to apply for consideration or to put forward the names of others for consideration must be publicly advertised prior to the selection of nominees; (

c) the criteria for selecting nominees must be included in the advertisement; 462

d) if the selection of nominees is to be made through a process that includes public input as to the relative suitability of various applicants for nomination, the process must be organized in such a way, including appropriate public advertisement, as to give members of the public an equal opportunity to decide whether or not to participate in the process; (

e) no person who is being considered for nomination to a board of directors, whether the person is a member of a CHB or of the general public, shall participate in the nomination process or selection of nominees; (

f) CHB members, by virtue of their membership on a CHB, must not be given any preference in the consideration of applicants for nomination; (

g) the CHB may conduct confidential interviews with applicants for nomination as part of its process and it may hold meetings with representatives of particular communities regarding the representation of those communities on the board of directors without inviting the general public to those meetings; (

h) the information about each applicant that serves as the basis on which nominees are selected will include the information submitted by or on behalf of the applicant, but the CHB may seek additional information about applicants as part of its process, provided that all information about an applicant that is relied on is available to the applicant on request; (

i) every applicant for nomination who is not selected will be provided, on their request, with an explanation of the process and the basis for the selection of the nominees; and (

j) the process to be used in selecting nominees must be established in writing prior to the commencement of the process and available on request to any member of the public, the DHA, the nomination committee or the Department of Health and any modifications to the process while in process should be of a minor nature only. 6 The nomination committee shall ensure that (

a) each CHB in the health district has the opportunity to nominate the minimum number of nominees that is the appropriate minimum number for the health district (which shall be at least one nominee) having regard to all relevant factors, including the number of nominees required, the number of CHBs in the health district and the distribution of population in the health district; 463

b) the allocation of nomination opportunities between CHBs balances population distribution against other factors, including the need for broad representation of communities on the board of directors; and (

c) where the nomination committee is responsible for selecting nominations in addition to those selected by CHBs, that due regard is given by the nomination committee or the process put in place by the nomination committee to the need for broad representation of communities on the board of directors. Criteria 7 The opportunity to apply for nomination shall be equally open to all residents of the health district, including CHB members, subject to the following exclusions pursuant to

Section 13 of the Act: being a member of the House of Assembly, a Member of Parliament, a Senator, a municipal councillor or a school board member. 8 A member of the board of directors shall (

a) have demonstrated community leadership or leadership potential; (

b) have knowledge of health issues and/or a willingness to learn; (

c) understand and be willing to accept the responsibility and accountability of being a member of a board of directors; (

d) be willing and able to commit the time necessary for the work of the board of directors; (

e) have the ability to work effectively as a member of a team; and (

f) have the ability to bring a useful perspective to the deliberations and work of the board of directors. 9 Collectively, the members of a board of directors should possess a range of skills and attributes conducive to effectiveness in the conduct of business by the board of directors. and reflect the diverse makeup of a health district and therefore, the following are to be considered assets in the consideration of candidates for nomination: (

a) population characteristics such as age, gender, ethnicity, geography or membership in a disadvantaged group; (

b) prior experience on boards of governance; and/or (

c) expertise, skills, or experience in areas such as financial management, business, law, health care, health or other public policy, community development, education or communications. 464

Reg. 124/2000 Made: June 29, 2000 Filed: June 30, 2000 Equity Tax Credit Regulations Order in Council 2000-351 made June 29, 2000 Amendment to regulations made by the Governor in Council pursuant to Sections 13A and 27 of the Equity Tax Credit Act The Governor in Council on the report and recommendation of the Minister of Finance dated June 1, 2000, pursuant to Sections 13A and 27 of

Chapter 3 of the Acts of 1993, the Equity Tax Credit Act, is pleased to amend the Equity Tax Credit Regulations made by Order in Council 94-86 dated February 2, 1994, in the manner set forth in

Schedule “A” attached to and forming part of the report and recommendation, effective on, from and after June 29, 2000.

Schedule "A" Amendments to the Equity Tax Credit Regulations made by the Governor in Council pursuant to Sections 13A and 27 of

Chapter 3 of the Acts of 1993, the Equity Tax Credit Act 1

(1) Section 2 of the Equity Tax Credit Regulations made by the Governor in Council by Order in Council 94-86 dated February 2, 1994, is amended by adding the following clause immediately after clause (a): (aa) “defined community” means a group of persons situated within the Province that may be reasonably distinguished by common geographic, economic or cultural characteristics;

(2) Clause 2(

h) of the regulations is amended by (

a) adding “or a community economic-development corporation” immediately after “corporation” in subclause (i); (

b) adding “or a community economic-development corporation” immediately after “corporation” in line two of subclause (ii); and (

c) adding “or a community economic-development corporation” immediately after “corporation” in line two of subclause (iii). 2 Clause 3(

a) of the regulations is amended by (

a) striking out “community” where it appears in subclause (

i) and substituting in each case “defined community”; and (

b) striking out “defines the geographical community” in subclause (ii) and substituting “describes the defined community”. 470

Part II Regulations 3 Clause 4(

a) of the regulations is amended by striking out “community” and substituting “defined community”. 4

Section 9 of the regulations is repealed. 5 Subsection 12(1) of the regulations is amended by striking out “subsection (2) of

Section 9” in subclause (d)(

i) and substituting “subsection 18A(2)”. 6

Section 15 of the regulations is amended by (

a) striking out the period at the end of clause (

b) and substituting a semi- colon; and (

b) adding immediately following clause (

b) the following clauses: (

c) details of investments made by a community economic-development corporation sufficient to determine compliance with clause 16(a); (

d) details of any purchase, redemption or acquisition of its shares by a community economic-development corporation sufficient to determine compliance with clause 16(b). 7 The regulations are further amended by adding the following Sections immediately after

Section 15: 16 For purposes of clause 6(1)(

d) of the Act, the Minister may revoke a certificate of registration of a community economic-development corporation where the corporation (

a) has not invested (

i) at least 40% of the equity capital raised in the Province in an eligible business entity within 12 months after the closing date of a specified issue, (ii) at least 60% of the equity capital raised in the Province in an eligible business entity within 24 months after the closing date of a specified issue, and (iii) at least 80% of the equity capital raised in the Province in an eligible business entity within 36 months after the closing date of a specified issue; (

b) has purchased, redeemed or otherwise acquired shares issued by it if (

i) the cost of the purchase, redemption or acquisition exceeds 20% of the corporation's retained earnings, or 471

Part II Regulations (ii) the purchase, redemption or acquisition results in the corporation being unable to pay its liabilities as they become due; (

c) fails to comply with the requirements of the Securities Act and the Community Economic-Development Corporations Regulations; (

d) fails to provide the applicable information or returns as provided in clauses 15(

c) or (d). 17

(1) For purposes of subsection 13A(2) of the Act, and subject to subsections (2), (3) and (4), (

a) where a community economic-development corporation is dissolved at any time on or before the 4th an[n]iversary of the closing date of an issue, the Province shall pay to each eligible investor in the corporation an amount equal to the difference between the amount received by the eligible investor on the wind-up of the corporation and 20% of the eligible investor's investment in the corporation; (

b) where, on the 4 th anniversary of the closing date of an issue, an independent valuation of the community economic-development corporation determines the value of eligible investments to be less than 20% of the initial eligible investments, the Province shall pay to each eligible investor the difference between the amount of the valuation and 20% of the eligible investor's initial investment.

(2) An application for payment pursuant to subsection (1) shall be (

a) made by the community economic-development corporation on behalf of its eligible investors; (

b) supported by an independent valuation carried out by a chartered business valuator; (

c) submitted to the Minister no later than 3 months after the 4 th anniversary of the closing date of the issue in respect of which the application is being made.

(3) For greater certainty, (

a) the guarantee provided for in

Section 13A of the Act shall be for a period not exceeding 4 years from the closing date of an issue; (

b) where the Province has made a payment pursuant to this Section, the Province shall have no further obligation respecting a guarantee of the issue in respect of which payment was made. 472

(1) For purposes of this Section, “restricted area” means the geographical areas of the Province comprising the former cities of Halifax and Dartmouth, the former town of Bedford, and the area commonly known as Sackville.

(2) No guarantee of an eligible investment shall be given where the proceeds of a special issue arising from the eligible investment are invested by a community economic-development corporation in a restricted area.

(3) Despite subsection (2), where a community economic-development corporation invests a portion of the proceeds in a restricted area and a portion of the proceeds outside a restricted area, a guarantee as described in

Section 17 shall apply to that portion invested outside of the restricted area. 473

Schedule "A" Amendments to the Aquaculture Licence and Lease Regulations made by the Governor in Council pursuant to

Section 64 of

Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act 1

Section 2 of the Aquaculture Licence and Lease Regulations made by the Governor in Council by Order in Council 2000-31 dated February 2, 2000, is amended by (

a) striking out the period at the end of clause (

b) and substituting a semicolon; and (

b) adding the following clause immediately after clause (b): (c) “u-fish pond” means a pond stocked with fish located on private property that does not require a water permit from the Department of the Environment, and, in the opinion of the Minister, is used primarily for the purpose of allowing persons to fish in the pond with rod and line for a fee. 2 Clause 6(1)(

a) of the regulations is repealed. 3 Clause 6(1)(

b) of the regulations is amended by striking out “100" and substituting “300 with a rebate of $100 for u-fish ponds". 4 Clause 6(1)(

d) Antigonish and Guysborough Counties; (

e) Pictou County; (

f) Halifax Regional Municipality; (

g) Colchester County; (

a) if the person's place of residence is in excess of 100 km from the place of attendance, the travel allowance for a person summoned for jury duty shall be $0.20/km for both ways between the place of attendance and the residence of the person within the jury district; (

b) the travel allowance for a juror shall be $0.20/km for both ways between the place of attendance and the residence of the juror within the jury district; (

c) the fee to be paid to a juror for attendance at a trial by the juror shall be $40 per day. 476
