B.C. Reg. 39/2009 , deposited March 2, 2009, pursuant to the EMPLOYMENT AND ASSISTANCE ACT [Section 37] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 27]. Order in Council 131/2009, approved and ordered February 27, 2009.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that, effective March 3, 2009, the Employment and Assistance Regulation, B.C. Reg. 263/2002, and the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, are amended as set out in the attached Schedule.

Schedule

Section 20 (1) of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended by repealing paragraphs (

a) to (

d) and substituting the following:

(

a) a spouse;

(

b) a spouse who has one or more dependent children from a former relationship;

(

c) a person who has never been a spouse and has one or more dependent children;

(

d) a person under 19 years of age who is not residing with his or her parents;

(

e) a spouse

(

i) who has one or more children from a former relationship who no longer are dependent children, and

(ii) is owed arrears under a maintenance order or maintenance agreement in respect of one or more of those children;

(

f) a person who

(

i) has never been a spouse,

(ii) has one or more children who no longer are dependent children, and

(iii) is owed arrears under a maintenance order or maintenance agreement in respect of one or more of those children.

Section 17 (1) of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended by repealing paragraphs (

a) to (

d) and substituting the following:

(

a) a spouse;

(

b) a spouse who has one or more dependent children from a former relationship;

(

c) a person who has never been a spouse and has one or more dependent children;

(

d) a person under 19 years of age who is not residing with his or her parents;

(

e) a spouse

(

i) who has one or more children from a former relationship who no longer are dependent children, and

(ii) is owed arrears under a maintenance order or maintenance agreement in respect of one or more of those children;

(

f) a person who

(

i) has never been a spouse,

(ii) has one or more children who no longer are dependent children, and

(iii) is owed arrears under a maintenance order or maintenance agreement in respect of one or more of those children.
