Land Surveyors Act

CODE OF ETHICS AMENDMENT REGULATION

section 16 of the Land Surveyors Act.

1 The Code of Ethics (AR 324/82) is amended by this

Regulation.

Section 1 is amended by striking out "his clientele and his

profession" and substituting "clients and the profession".

Section 2 is amended

(

a) in subsection (1) by striking out "his";

(

b) by repealing subsection (3) and substituting the

following:

(3) An Alberta land surveyor has a duty to preserve the confidences of

clients and regard as privileged the information the Alberta land

surveyor obtains regarding the affairs of clients.

(

c) in subsection (4) by striking out "his client and shall

represent his client"and substituting "clients and shall

represent clients";

(

d) in subsection (6) by striking out "through his

association with his" and substituting "in every

association with";

(

DISCIPLINE AMENDMENT REGULATION

section 16 of the Land Surveyors Act.

1 The Discipline Regulation (AR 325/82) is amended by this

Regulation.

Section 1(1) is amended

(

a) by repealing clause (

b) and substituting the

following:

(b) "chair" or "vice-chair" means respectively the chair or a

vice-chair of the Discipline Committee;

(

b) by adding the following after clause (b):

(c) "recorded mail" means a form of document delivery by

mail or courier in which receipt of the document must

be acknowledged in writing by the recipient.

Section 2 is amended

(

a) in subsection (2) by striking out "chairman" and

substituting "chair";

(

b) in subsection (3) by striking out "chairman or a

vice-chairman" and substituting "chair or a vice-chair".

Section 4(2) is amended

(

a) by striking out "chairman or a vice-chairman" wherever

it occurs and substituting "chair or a vice-chair";

(

b) in clause (

b) by striking out "him" and substituting

"the complainant".

Section 5 is amended

Section 6(

g) is amended by adding "and to any solicitor

providing independent legal advice to the Discipline Committee or the

Council" after "Association".

Section 7(1) is amended by striking out "aply" and

substituting "apply".

Section 8 is amended

(

a) by striking out "If a practitioner is suspended or his

registration is cancelled for 1 year or more he" and

substituting "If the registration of a practitioner is

suspended or cancelled for 1 year or more, the practitioner";

(

b) by striking out "his reinstatement" and substituting

"reinstatement of the registration".

Land Surveyors Act

EXAMINATION AND TRAINING AMENDMENT REGULATION

1 The Examination and Training Regulation (AR 86/2003) is

amended by this Regulation.

Section 1 is amended

(

a) by adding the following after clause (c):

(c.1) "domestic trade agreement" means a domestic trade

agreement as defined in

section 2 of

Schedule 6 to the

Government Organization Act;

(

b) by repealing clause (

d) and substituting the

following:

(d) "Examination Board" means the Canadian Board of

Examiners for Professional Surveyors or other Board as

may from time to time be designated by the Council;

Section 2 is amended by repealing clause (

b) and

substituting the following:

(

b) the Alberta land surveyor has been engaged in the active

practice of surveying as an Alberta land surveyor for at least

the 2 years immediately preceding the date the articles are

proposed to be entered into,

Section 3(6)(

a) is amended by striking out "Registrar" and

substituting "Association".

Section 6 is amended

(

a) in subsection (1) by striking out "Registrar" and

substituting "Registration Committee";

(

b) in subsection (3) by striking out "Registrar" and

Section 10 is repealed and the following is substituted:

Leave from articles

10(1) A pupil may, with the approval of the pupil's principal and

the Registration Committee, take a leave from the pupil's articles

(

a) for the purposes of attending a course of study at a university,

college or technical school, or

(

b) for the purposes of a maternity or parental leave under the

Employment Standards Code.

(2) A pupil must provide the Registration Committee with a letter

signed by both the pupil and the pupil's principal setting out the

details of the leave.

(3) The period of time that the pupil is on leave may not be

considered field practice or office practice for the purposes of

section 4(2).

Section 12 is amended

(

a) by repealing subsections (1) and (2) and

substituting the following:

Breach of articles

12(1) If a pupil

(

a) leaves the service of the pupil's principal without

consent,

(

b) breaches any of the pupil's obligations under the pupil's

articles, or

(

c) is involved in conduct that may put in question the

pupil's good character,

the principal or the Association may report the matter to the

Registration Committee.

(2) If a pupil's employment with the principal is terminated by

the principal, the pupil or the Association may report the matter

to the Registration Committee.

(

b) in subsection (3)

(

i) by striking out "or (2)";

(ii) by striking out "or" at the end of clause (c),

adding "or" at the end of clause (

d) and adding

the following after clause (d):

(

e) order that the pupil enter into a transfer of articles

with another Alberta land surveyor.

(

c) by adding the following after subsection (3):

(4) On receipt of a report under subsection (2), the

Registration Committee may meet with the pupil, or the pupil

and the principal, and may

(

a) order that the articles be continued, or

(

b) provide advice, suggestions or direction as to the future

conduct of the pupil or the principal, or both.

Section 13(2) is amended by striking out "Registrar"

wherever it occurs and substituting "Association".

Section 14 is amended

(

a) in subsection (1)

(

i) by striking out "or" at the end of clause (a);

(ii) by striking out "Registrar" wherever it occurs

and substituting "Association";

(iii) by adding "or" at the end of clause (

b) and

adding the following after clause (b):

(

c) to pass any of the professional practice

examinations after 3 attempts,

(

b) by repealing subsection (2) and substituting the

following:

(2) If a pupil's articles are terminated under subsection (1), the

pupil may apply to the Registration Committee for approval of

new articles after paying any required fees prescribed in the

General Bylaws.

Section 15(1) is repealed and the following is

substituted:

Transfer of articles required

15(1) Unless otherwise permitted by the Registration Committee, if

a principal ceases to engage in the practice of land surveying in

Alberta, the principal must transfer the articles of a pupil to another

Alberta land surveyor permitted to accept pupils in accordance with

section

Section 16 is amended

(

a) in subsection (1) by striking out ", whether or not the

articles are terminated and subsequent articles are entered

into";

(

b) in subsection (2) by repealing clause (

a) and

substituting the following:

(

a) by the same period of time as a leave that the pupil

takes under

section 10, or

Section 17 is amended

(

a) by repealing subsection (1) and substituting the

following:

Prior service

17(1) Unless the Registration Committee otherwise permits, if

a pupil's articles are terminated and the Registration

Committee approves an application for new articles, the pupil

must subsequently

(

a) pass all of the professional practice examinations, and

(

b) complete all of the field practice and office practice

requirements under

section 4(2),

even if the pupil had completed any or all of these

examinations or practice requirements during prior articles.

(

b) in subsection (2) by striking out "prior service is

credited" and substituting "the Registration Committee

permits credit for prior service";

(

c) by adding the following after subsection (2):

(3) Subsections (1) and (2) do not apply in respect of articles

terminated under

section 14(3) or 15(2).

Section 18 is amended by striking out "Registrar" and

substituting "Registration Committee".

Section 20 is repealed and the following is substituted:

Canadian land surveyors

20 An applicant is entitled to be registered as an Alberta land

surveyor if the applicant

(

a) meets the requirements of

section 24,

(

b) is an individual who is licensed under the Canada Lands

Surveyors Act (Canada) or is registered as a land surveyor in

good standing with a professional regulatory organization

governing land surveying in a province or territory of Canada

that is a signatory to a domestic trade agreement in force in

Alberta at the time the application is made, and

(

c) passes an examination designed to test the level of

knowledge of specific surveying topics unique to Alberta.

Section 22 is amended

(

a) by striking out "Registrar" wherever it occurs and

substituting "Association";

(

b) in clause (

a) by striking out "6 weeks" and

substituting "2 weeks".

Section 24 is amended

(

a) in subsection (1)

(

i) in clause (d)

(

A) by striking out "Registrar" and substituting

"Association";

(

B) by adding "and" after "Bylaws,";

(ii) by repealing clause (e);

(iii) by repealing clause (

f) and substituting the

following:

(

f) take and subscribe the oath of office, set out in the

Schedule, before

(

i) the chair of the Registration Committee, a

member of the Council or the Registrar if the

chair, member or Registrar, as the case may

be, is a commissioner for oaths in and for

Alberta,

PROFESSIONAL PRACTICE AMENDMENT REGULATION

1 The Professional Practice Regulation (AR 327/82) is

amended by this Regulation.

Section 1 is amended

(

a) by adding the following after clause (b):

(b.1) "Canadian land surveyor" means an individual who is

licensed under the Canada Lands Surveyors Act

(Canada) or is registered as a land surveyor in good

standing with a professional regulatory organization

governing land surveying in a province or territory of

Canada that is signatory to a domestic trade agreement,

as defined in

section 2 of

Schedule 6 of the Government

Organization Act, in force in Alberta;

(

b) in clause (

c) by striking out "his" and substituting

"the Alberta land surveyor's".

Section 4 is amended

(

a) in subsections (2) and (3)(

(

CALGARY INTERNATIONAL AIRPORT VICINITY

PROTECTION AREA AMENDMENT REGULATION

1 The Calgary International Airport Vicinity Protection Area

Regulation (AR 177/2009) is amended by this Regulation.

Schedule 3 is amended

(

a) in

section 1

(

i) by renumbering clause (

a) as clause (a.1) and

adding the following before clause (a.1):

(a) "attached suite" means a self-contained dwelling

unit that meets the building code requirements of a

secondary suite, with its own living, cooking,

sleeping and bathroom facilities, that is located in

an existing dwelling, and includes a secondary

suite;

(ii) by adding the following after clause (c.1):

(c.2) "detached suite" means a self-contained dwelling

unit that meets the relevant building code

requirements, with its own living, cooking,

sleeping and bathroom facilities, that is

(

i) part of or attached to an accessory building

on the same parcel of land as an existing

dwelling, or

(ii) located in a detached building on the same

parcel of land as an existing dwelling;

(iii) by adding the following after clause (m):

(n) "semi-detached dwelling" means a building that

contains no more than 4 dwelling units located side

by side and separated by a common wall extending

from foundation to roof.

b) by adding the following after

(2) Despite any other provision of this Regulation, the

following types of subdivision and development for

residential use are permitted with respect to the land

described in subsection (1), subject to compliance with any

applicable statutory plan and land use bylaw and the

acoustical requirements set out in the Alberta Building

Code:

(

a) the subdivision of a single parcel into 2 parcels,

with no further subdivision permitted;

(

b) the subdivision of a corner lot parcel into 4 or

fewer parcels, with no further subdivision

permitted;

(

c) the development of a single detached dwelling;

(

d) the development of semi-detached dwellings

(

i) with no more than 4 dwelling units on a

corner lot parcel, or

(ii) with no more than 2 dwelling units on a

parcel that is not a corner lot parcel;

(

e) subject to subsection (3), the development of an

attached suite;

(

f) subject to subsection (3), the development of a

detached suite.

(3) The development of both an attached suite and a

detached suite is not permitted

(

a) on the same parcel,

(

b) in respect of the same single detached dwelling, or

(

c) in respect of the same dwelling unit of a semi-

detached dwelling referred to in subsection

(2)(d)(ii).

(2)(

b) where there is a semi-detached dwelling with 3 or

more dwelling units.

Insurance Act

INSURANCE AGENTS AND ADJUSTERS AMENDMENT REGULATION

1 The Insurance Agents and Adjusters Regulation

(AR 122/2001) is amended by this Regulation.

Section 5 is amended by adding the following after

subsection (1):

(1.1) Subsection (1)(

a) does not apply in circumstances where the

individual is not required to pass an examination pursuant to

section

9(6)(

a) or (e).

Section 9(6) is amended by striking out "or" at the end of

clause (c), by adding "or" at the end of clause (

d) and by

adding the following after clause (d):

(

e) if

(

i) the individual provides evidence satisfactory to the

Alberta Insurance Council that the individual has passed

a course or an examination that the Alberta Insurance

Council has accepted as equivalent to the examinations

referred to in subsection (1), (3) or (4), and

(ii) in the case of an application referred to in subsection

(1) or (3), the individual has passed a course or an

examination referred to in subclause (

i) within the

previous 12 months of the application.

4 The heading to

Part 4 is amended by striking out

"Repeals, Expiry" and substituting "Repeal".

Section 40 is repealed.
