SALARY RESTRAINT AMENDMENT REGULATON

on September 13, 2019 pursuant to sections 5 and 23 of the Reform of Agencies,
Boards and Commissions Compensation Act.
1 The Salary Restraint Regulation (AR 6/2018) is amended
by this Regulation.
Section 1 is amended by repealing clause (
e) and
substituting the following:
(e) "restraint period" means the period April 1, 2018 to
December 31, 2019;
Section 8 is amended by striking out "September 30, 2019"
and substituting "December 31, 2019".

EGG FARMERS OF ALBERTA MARKETING
AMENDMENT REGULATION

pursuant to sections 26 and 27 of the Marketing of Agricultural Products Act.
1 The Egg Farmers of Alberta Marketing Regulation
(AR 293/97) is amended by this Regulation.
Section 1(1) is amended
(
a) in clause (
c) by striking out "hatcheryman" and
substituting "hatcheryperson";
(
b) in clause (
d) by striking out "allocated" and
substituting "allotted";
(
c) by adding the following after clause (e.1):
(e.2) "quota policies" means the Board's policies relating to
quota, including policies relating to quota allotment, the
transfer of quota and the leasing of quota, as amended
from time to time;
Section 8 is amended
(
a) in subsection (1)(c.1)
(
i) in subclause (
i) by striking out "Board's";
(ii) in subclause (ii) by striking out "Board's";
(iii) by striking out "or" at the end of subclause (iii)
and by repealing subclause (iv) and
substituting the following:
(iv) lacks the ability to comply with the animal care
policy, or
(
v) refuses to comply with the animal care policy,
(
b) in subsection (1.1) by striking out "Board's";
(
c) in subsection (2)
(
i) in clause (
b) by striking out "has sold, leased or
otherwise assigned" and substituting "sells, leases or
otherwise assigns";
(ii) in clause (c)(ii) by striking out "has ceased
holding" and substituting "ceases to hold";
(iii) in clause (d)
(
A) in subclause (
i) by striking out "has stopped"
and substituting "stops";
(
B) by repealing subclause (ii) and
substituting the following:
(ii) fails to comply with the on-farm food safety
policy,
(iv) in clause (e)(ii) by striking out "has failed" and
substituting "fails";
(
d) in subsection (2.1) by striking out "Board's".
Section 12 is repealed and the following is substituted:
Allotting quota
12(1) If the Board determines that the total provincial allotment of
quota should be increased, the increase shall be
(
a) allotted to new entrants under the new entrants policy,
(
b) allotted to registered producers as additional quota, in
accordance with Council policy and the quota policies, or
(
c) retained by the Board under
section 29.1.
(2) If the Board determines that the total provincial allotment of
quota should be decreased, the Board may apportion the decrease
between existing registered producers and the quota retained by the
Board under
section 29.1 in accordance with Council policy and the
quota policies.
(3) When a registered producer is allotted additional quota under
subsection (1)(b), the registered producer shall, within 10 years after
the date the additional quota is allotted,
(
a) ensure that all or part of the additional quota is in production
in the facilities of the registered producer, and
(
b) transfer, in accordance with this Regulation, any of the
additional quota not in production.
(4) Any additional quota that is not in production or that has not been
transferred within the time period referred to in subsection (3) reverts
to the Board.
Section 13 is amended
(
a) by repealing subsection (1) and substituting the
following:
Transfer of quota with production facilities
13(1) No registered producer shall transfer any of the
registered producer's quota with production facilities except in
accordance with this
section and the quota policies, and a
transfer of quota other than in accordance with this Regulation
is void.
(
b) by repealing subsection (2) and substituting the
following:
(2) A registered producer who wishes to transfer a quota with
production facilities shall make an application for transfer of
quota to the Board.
(
c) in subsection (3) by adding "with production facilities"
after "transfer of quota";
(
d) by repealing subsection (6).
6 The following is added after
section 13:
Transfer of quota without production facilities
13.1(1) No registered producer shall transfer any of the registered
producer's quota without production facilities except in accordance
with this
section and the quota policies, and a transfer of quota other
than in accordance with this Regulation is void.
(2) The Board shall establish a quota exchange for the purpose of
facilitating the transfer of quota without production facilities
between registered producers.
(3) No registered producer shall transfer a quota without production
facilities other than through the quota exchange.
(4) A registered producer who wishes to transfer a quota without
production facilities through the quota exchange shall
(
a) make an application for transfer of quota to the Board in
accordance with the quota policies, and
(
b) pay any transfer fee required under the quota policies.
(5) This
section does not apply to a registered producer who is
transferring quota without production facilities to
(
a) a family member of the registered producer, or
(
b) a daughter colony originating from the registered producer's
colony of the Hutterian Brethren Church.
Approval of application to transfer quota
13.2(1) The Board shall not approve an application to transfer a
quota under
section 13 or 13.1 unless the following requirements are
met:
(
a) the transferee has been or will be issued a licence to operate
as a producer under this Regulation;
(
b) subject to subsection (2), the registered producer applying to
transfer the quota has been in continuous production of the
regulated product for not less than 3 years immediately
preceding the date of the application to transfer the quota to
the transferee;
(
c) the transferee undertakes to the Board that the quota to be
transferred will be in production in the production facilities
of the transferee within 10 years after the date the quota is
transferred;
(
d) the transferee and the transferee's production facilities
comply with the on-farm food safety policy and the animal
care policy;
(
e) the registered producer applying to transfer the quota has
paid the transfer fee required under
section 13(4) or the quota
policies, as applicable.
(2) The Board may exempt a registered producer from the
requirement in subsection(1)(
b) if the Board is satisfied that
extenuating circumstances exist.
Section 14(3) is amended by striking out "or" at the end
of clause (
b) and by adding the following after clause (c):
(
d) an unincorporated organization, a majority of the members of
which are Canadian citizens or persons who are lawfully
admitted to Canada for permanent residence, that is not a
partnership referred to in clause (c), or
(
e) a group of individuals who are carrying on an activity for a
common purpose, a majority of the members of which are
Canadian citizens or persons who are lawfully admitted to
Canada for permanent residence, that is not a partnership
referred to in clause (
c) or an unincorporated organization
referred to in clause (d).
Section 16 is repealed and the following is substituted:
Lease of quota
16(1) No registered producer shall lease any of the registered
producer's quota to another registered producer except in accordance
with this
section and the quota policies, and a lease of quota other
than in accordance with this Regulation is void.
(2) The Board shall establish and administer a quota leasing pool.
(3) No registered producer shall lease any of the registered
producer's quota to another registered producer other than through
the quota leasing pool.
(4) A registered producer who wishes to lease all or part of the
registered producer's quota to another registered producer shall
make an application to the Board in accordance with the quota
policies.
Section 20(1)(
a) is repealed and the following is
substituted:
(
a) the amount, size, grade, type and colour of eggs and the type
of hen housing system,
Section 21 is amended by striking out "hatcheryman"
wherever it occurs and substituting "hatcheryperson".
Section 22(
c) is amended by adding "lease, " after
"transfer,".
Section 28(5) is amended by adding "or 13.1" after
"section 13".
Section 29 is amended by striking out "Board's".
Section 29.1 is amended by adding "and (b)" after "section
12(1)(a)".
Section 29.3 is amended
(
a) by striking out "or (3)" and substituting "or (4)";
(
b) by striking out "29(4),".
Section 32 is amended by striking out "September 30,
2019" and substituting "September 30, 2024".
