Heather Beach Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 80-662 (May 20, 1980), N.S. Reg. 84/80

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 1st day of May, A.D., 1980, and pursuant to

Section 2 of

Chapter 244 of the

Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act , is pleased to:

(

a) constitute all that area of land situate at Heather Beach, in the County of

Cumberland, owned by Her Majesty in the right of the Province of Nova

Scotia, to be a Provincial Park, the said area of land being described in

Schedule “A” and shown outlined in red on the copy of Crown Land Records

Plan No. E-5-73 marked

Schedule “B”, excepting the lands shown shaded in

green on

Schedule “B”, both Schedules attached to and forming part of the

report and recommendation; and

(

b) declare that the park shall be known by the name of “Heather Beach Provincial

Park”.

Schedule “A”

All those certain three lots, pieces or parcels of land situate, lying and being at Heather Beach,

in the County of Cumberland, Province of Nova Scotia designated as Lot 1, Lot 2 and Lot 3 as

shown outlined in red on the copy of Crown Land Records Plan No. E-5-73 marked

Schedule “B”, the said three lots being more particularly described as follows:

Lot 1

Beginning at a Crown Land Iron Post designated A on said plan and marking the northeast

corner of lands now or formerly of A. Jardine and situate on or near the mean high water mark

of Northumberland Strait;

From thence (by astronomic bearing) S 02° 59' W, a distance of 197.4 feet along the eastern

boundary of lands now or formerly of A. Jardine to Crown Land Iron Post B;

Thence S 87° 25' W, a distance of 98.0 feet along the southern boundary of lands now or

formerly of A. Jardine to Crown Land Iron Post C-1 situate on the eastern boundary of lands

now or formerly of Mrs. John Dunbar;

Thence S 23° 51' E, a distance of 20 feet along the eastern boundary of lands now or formerly

of Mrs. John Dunbar to Crown Land Iron Post D;

Thence N 87° 25' E, a distance of 304.8 feet to Crown Land Iron Post E situate on the eastern

boundary of a private road;

Thence N 13° 45' W, a distance of 79.1 feet along the eastern boundary of said private road to

Crown Land Iron Post F;

Thence S 75° 40' 00" E, a distance of 169.8 feet to Crown Land Iron Post G;

Thence S 78° 30' E, a distance of 92.6 feet to Crown Land Iron Post C-1524;

Thence S 16° 03' E, a distance of 100.0 feet to Crown Land Iron Post C-1525;

Thence S 79° 11' E, a distance of 125.0 feet to Crown Land Iron Post C-1526;

Thence N 07° 55' W, a distance of 94.3 feet to Crown Land Iron Post C-1523;

Thence S 78° 30' E, a distance of 163.8 feet to Crown Land Iron Post H;

Thence S 22° 07' E, a distance of 157.1 feet to Crown Land Iron Post I;

Thence N 85° 13' E, a distance of 434.5 feet to Crown Land Iron Post J;

Thence S 23° 52' E, a distance of 27.5 feet to Crown Land Iron Post K;

Thence N 54° 03' E, a distance of 190.8 feet to Crown Land Iron Post L marking the southwest

corner of lands now or formerly of Leo White;

Thence N 24° 35' W, a distance of 197.0 feet along the western boundary of lands now or

formerly of Leo White to Crown Land Iron Post M-1;

Thence continuing N 24° 35' W, a distance of 14 feet to the mean high water mark of the

aforementioned Northumberland Strait;

Thence westerly, a distance of 1,290 feet more or less following the mean high water mark of

Northumberland Strait to the place of beginning.

Excepting and reserving from Lot 1 the public road shown shaded in green on

Schedule “B”.

The said described Lot 1 contains 7.3 acres.

Lot 2

Beginning at Crown Land Iron Post C-1033 situate on the western boundary of a public road

and marking a northeastern corner of lands now or formerly of J. Russell Cameron;

From thence (by astronomic bearing) S 84° 46' 50" W, a distance of 1,199.3 feet along a

northern boundary of lands now or formerly of J. Russell Cameron to Crown Land Iron Post

C-1034 situate on an eastern boundary of lands now or formerly of Mrs. John Dunbar;

Thence N 23° 42' 30" W, a distance of 209.4 feet along the eastern boundary of lands now or

formerly of Mrs. John Dunbar to Crown Land Iron Post C-1035;

Thence N 81° 30' 40" E, a distance of 344.1 feet to Crown Land Iron Post C-1036;

Thence S 16° 40' 40" E, a distance of 28.5 feet to Crown Land Iron Post C-1037;

Thence N 84° 37' 10" E, a distance of 638.4 feet following the southern boundary of a public

road to Crown Land Iron Post C-1038;

Thence continuing N 84° 37' 10" E, following the southern boundary of said public road a

distance of 50 feet to Crown Land Iron Post C-1041;

Thence continuing N 84° 37' 10" E, following the southern boundary of said public road a

distance of 165.0 feet to Crown Land Iron Post C-1042;

Thence S 23° 21' 10" E, a distance of 203.0 feet along the western boundary of the first

mentioned public road to the place of beginning.

The said described Lot 2 contains 5.41 acres.

Lot 3

Beginning at Crown Land Iron Post C-1023 situate on the western boundary of lands now or

formerly of Miss Jennie Dunbar, and being 143.9 feet on an astronomic bearing of

S 23° 57' 20" E from the southeast corner of lands now or formerly of Leo White;

From thence S 23° 57' 20" E, a distance of 634.7 feet along the western boundary of lands now

or formerly of Miss Jennie Dunbar to Crown Land Iron Post C-1024 marking the northeast

corner of lands now or formerly of J. Russell Cameron;

Thence S 84° 36' 30" W, a distance of 259.8 feet along a northern boundary of lands now or

formerly of J. Russell Cameron to Crown Land Iron Post C-1025;

Thence S 24° 27' 50" E, a distance of 261.8 feet along a western boundary of lands now or

formerly of J. Russell Cameron to Crown Land Iron Post C-1026;

Thence S 69° 29' 40" W, a distance of 103.9 feet along a northern boundary of lands now or

formerly of J. Russell Cameron to Crown Land Iron Post C-1027 situate on the eastern

boundary of a public road;

Thence N 23° 21' 10" W, a distance of 574.9 feet along the eastern boundary of said public

road to Crown Land Iron Post C-1028;

Thence N 54° 03' E, a distance of 84.0 feet to Crown Land Iron Post C-1029;

Thence N 23° 57' 20" W, a distance of 60.0 feet to Crown Land Iron Post C-1030;

Thence N 54° 03' E, a distance of 165.2 feet to Crown Land Iron Post C-1031;

Thence N 23° 57' 20" W, a distance of 100.0 feet to Crown Land Iron Post C-1032;
