EXPLANATORY NOTES

Clause 1 of the Bill would amend the Occupational Health and Safety Act by updating

the

definitions of "assistant deputy minister" and "minister".

Clause 2 of the Bill would amend the

Act by changing the limitation period during which offences under the Act or

regulations may be prosecuted.

AN ACT TO AMEND THE OCCUPATIONAL HEALTH AND

SAFETY ACT

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

(1) Paragraph 2(

a) of the Occupational Health and Safety Act is repealed and the following substituted:

(a) "assistant deputy minister" means an

assistant deputy minister appointed under

section 9 of the Executive Council Act for the proper conduct of this Act;

(2) Paragraph 2(

g) of the Act is repealed and the

following substituted:

(g) "minister" means the minister

appointed under the Executive Council Act

to administer this Act;

Section 70 of the Act is repealed and the

following substituted:

Limitation period

70. A

prosecution under this Act or the regulations shall be started within 2 years

(

a) the date upon which the offence is alleged to

have been committed; or

(

b) the date upon which an assistant deputy minister

or an officer of the Occupational Health and Safety Division becomes aware of

the alleged offence,

whichever is later.
