Section 1 of the Pension Benefits Act,

chapter P-5.1 of the Statutes of New Brunswick, 1987, is amended 1 L’article 1 de la

a) in subsection (1)

i) by repealing the definition “spouse” and sub- stituting the following: (

a) by repealing subsection (1) and substituting the following:

section 35, the spouse or common-law partner of the deceased former member at the date of death is entitled to a payment equal in amount to the commuted value of the deferred pension. 43.1(1)

43.1(6) Where the member or former member does not have a spouse or common-law partner at the date of death and has not designated a beneficiary under subsection (4), the payment shall be made to the estate of the member or former member. 43.1(6) Lorsque le participant ou l’ancien participant n’a pas de conjoint ou conjoint de fait à la date du décès et n’a pas désigné un bénéficiaire en vertu du paragra- phe (4), le paiement doit être fait à la succession du participant ou de l’ancien participant. 43.1(7) Where the member or former member is covered by a group life insurance plan sponsored, and paid for wholly or in part, by the employer, and the benefit to the surviving spouse, surviving common-law partner, desig- nated beneficiary or estate under that plan is at least equal to the benefit referred to in subsection (1) or (2), a pension plan may provide that the benefit referred to in subsection (1) or (2) does not apply and the administrator shall pay to the surviving spouse, surviving common-law partner, des- ignated beneficiary or estate, as the case may be, a sum equal to the contributions of the member or former mem- ber with interest. 43.1(7) Lorsque le participant ou l’ancien participant fait

44(9) If a competent tribunal makes a degree, order or judgment in relation to the division of a pension under a pension plan on the breakdown of a marriage or common-law partnership, the commuted value of the pen- sion, taking into account any survivor rights under the pension plan, shall be determined in accordance with this Act and the regulations as of the date of the breakdown of the marriage or common-law partnership and shall be div- ided in accordance with the decree, order or judgment of the tribunal. 44(9) Lorsqu’un tribunal compétent rend une ordon- nance, un jugement ou un arrêt, relativement à la réparti- tion à la rupture du mariage ou de l’union de fait d’une pension en vertu d’un régime de pension, la valeur de ra- chat de la pension, compte tenu de tous droits du survivant en vertu du régime de pension, doit être déterminée con- formément à la présente loi et aux règlements à la date de la rupture du mariage ou de l’union de fait et répartie con- formément à l’ordonnance, au jugement ou à l’arrêt du tribunal. 44(10) The value of the pension determined under sub- section (9) that is to be attributed to the spouse or common-law partner of the former member shall be dealt with in accordance with
