An Act to Amend the Human Rights Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The Human Rights Act

chapter H-11 of the Revised Statutes, 1973, is amended by adding after subsection 10(4) the following: 10(4.1) No fewer than one hundred and twenty days prior to the making of any appointment, the Lieutenant- Governor in Council shall cause to be published public notice of the intention to make appointments and shall in- vite applications from qualified members of the public. 10(4.2) In appointing members to or designating the Chair of the Commission, the Lieutenant-Governor in Council shall give preference to candidates who meet the following criteria: (

a) demonstrate evidence of past experience in the field of adjudicating or defining human rights, (

b) possess past experience in promoting and further- ing human rights, and (

c) possess the needed management and administra- tive skills necessary to carry out their duties. PROJET DE LOI Loi modifiant la

chapitre H-11 des Lois révisées de 1973, est modifiée par l’adjonction après le paragraphe 10(4) de ce qui suit : 10(4.1) Pas moins de cent-vingt jours avant de faire toute nomination, le lieutenant-gouverneur en conseil doit assurer la publication d’un avis public qui explique l’in- tention de faire des nominations et qui invite la candida- ture des membres du public qualifiés. 10(4.2) En faisant la nomination des membres ou du président de la Commission, le lieutenant-gouverneur en conseil doit accorder la préférence aux candidats qui ren- contrent les critères suivants : (

a) démontre une expérience antérieure dans la prise de décision en matière des droits de la personne et dans la définition des droits de la personne, (

b) possède de l’expérience dans la promotion et l’avancement des droits de la personne, et (

c) possède les compétences en gestion et en admi- nistration nécessaires à leur fonction. 2 Projet de loi Loi modifiant la

Loi sur les droits de la personne 10(4.3) In making an appointment, the Lieutenant- Governor in Council shall also consider the composition of the Commission in terms of regional representation, gender balance and representation of different sectors di- rectly affected by the Act. 10(4.4) In announcing any appointments, the Lieutenant- Governor in Council shall cause to be published in writ- ing, an explanation of the qualifications of each appointee based upon the criteria and considerations enumerated in subsections (4.2) and (4.3). 10(4.3) En faisant toute nomination, le lieutenant- gouverneur en conseil doit, en ce qui concerne la compo- sition, tenir compte de la représentation des régions, de l’équilibre des sexes, et de la représentation de la popula- tion qui proviennent des divers secteurs directement tou- chés par la Loi. 10(4.4) En annonçant toute nomination, le lieutenant- gouverneur en conseil doit assurer la publication écrite des détails des compétences de chaque personne nommée en vertu des critères et des considérations énumérées aux paragraphes (4.2) et (4.3).
