N ovember 24, 1994 - 8:15 a.m. B I L L N o. of A n Act to amend The Medical Profession Act, 1981 ( Assented to , 1995) HE R MAJESTY, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows: Sh ort title This Act may be cited as The Medical Profession Amendment Act, 1995. S .S. 1980-81, c.M-10.1 amended The Medical Profession Act, 1981 is amended in the manner set forth in this Act. N ew

section 29

Section is repealed and the following substituted: AProvisional licence, registration 29(1) The council may register and issue a provisional licence to a person who does not meet the requirements necessary for registration or for a licence pursuant to

section 28, but who: (

a) otherwise meets the requirements for registration that are presc ribed in the bylaws; and (

b) pays the fee prescribed by the council.

(2) A provisional licence issued pursuant to subsection (1) authorizes the person named in the licence to practice: (

a) subject to any restrictions that are imposed by the council in the licence; an d (

b) subject to any restrictions contained in the bylaws @. S ection amended 4(1) Clause 30(2)(

c) is repealed and the following substituted: A(

c) is to be engaged as a psychiatrist in a branch of the public service of Saskatchewan or a district health board@. 39 MEDICAL PROFESSION AMENDMENT ACT, 1995 November 24, 1994 - 8:15 a.m. (2) Clause 30(3)(

b) is repealed and the following substituted: A(

b) is to be engaged: (

i) in a branch of the public service of Saskatchewan; (ii) in a hospital or other institution; or (iii) as a designated public health officer for a district health board @.

Section is repealed.

Section amended Subsection 47(3) is repealed and the following subsections substituted: A(3) A preliminary inquiry committee may take any steps that it considers proper and may summon any member who is under investigation and any other person whose information may be relevant to the investigation. A(3.1) On application and payment of the appropriate fee, the local registrar of the court at any judicial centre shall issue writs of subpoena ad testificandum or subpoena duces tecum to: (

a) a member of the preliminary inquiry committee; (

b) counsel acting for the preliminary inquiry committee. A(3.2) Where a writ issued pursuant to subsection (3.1) is diso beyed, the proceedings and penalties are those applicable in civil cases in the court. A(3.3) Where any book, paper, document or thing is produced to the preliminary inquiry committee, the committee may authorize any person to copy or make extracts from the book, paper, document or thing@.

Section 47.3 amended

Section 47.3 is amended in the portion following clause (

b) by striking out Asubsection 47.2(2)@ and substituting Asubsection 47(3) or 47.2(2)@.

Section amended Subsection 53(1) is amended by striking out Ashall, for all such proceedings,@ and substituting Amay, for all or a portion of those proceedings,@.

section 91.1 The following

section is added after

section 91: AAnnual report 91.1 The college shall file an annual report with the minister in the form, with the contents and i n the time prescribed by the minister@. Coming into force This Act comes into force on assent.
