B.C. Reg. 71/2018 , deposited April 13, 2018, under the LOBBYISTS REGISTRATION AMENDMENT ACT, 2017 [section 10] and the LOBBYISTS REGISTRATION ACT [section 11 (2)]. Order in Council 169/2018, approved and ordered April 13, 2018.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective May 1, 2018,

(

a) the Lobbyists Registration Amendment Act, 2017 , S.B.C. 2017, c. 19, is brought into force, and

(

b) the Lobbyists Registration Regulation, B.C. Reg. 284/2002, is amended as set out in the attached Schedule.

Schedule

Section 1.3 of the Lobbyists Registration Regulation, B.C. Reg. 284/2002, is repealed and the following substituted:

What is a Provincial entity

1.3

(1) For the purposes of paragraph (a) (i), (iv), (v), (vi) and (vii) of the definition of “lobby” in

section 1 (1) of the Act and for the purposes of sections 2.1 (1) and 4 (1) (

k) of the Act, the following are prescribed as Provincial entities:

(

a) those entities that make up the government reporting entity within the meaning of the Budget Transparency and Accountability Act , except the government as reported through the consolidated revenue fund;

(

b) the Workers’ Compensation Board.

(2) For the purposes of paragraph (c) (iii) of the definition of “former public office holder” in

section 1 (1) of the Act and for the purposes of

section 1 (3) (

d) of the Act, the Provincial entities identified in the Appendix to this regulation are prescribed.

Section 1.4 is amended

(

a) by repealing subsection (1) and substituting the following:

(1) For the purposes of paragraph (c) (iii) of the definition of “former public office holder” in

section 1 (1) of the Act, an individual is a former public office holder if the individual

(

a) formerly occupied the most senior or next most senior ranking executive position in a Provincial entity identified in the Appendix, or

(

b) was the chair or a vice chair of, or held the equivalent position in, the governing body of a Provincial entity identified in the Appendix. , and

(

b) in subsection (2) by striking out “ occupies ” and substituting “ formerly occupied ” and by striking out “ deemed to hold ” and substituting “ deemed to have occupied ”.

Section 4 is repealed and the following substituted:

Administrative penalty provisions

4 For the purposes of

section 7.2 (2) (

b) of the Act, sections 2.1 (2), 2.2, 3 (1) and (3) and 4 (1) and (2) to (4) of the Act are prescribed.

4 The following Appendix is added:
