NOTICE OF MINISTER’S DETERMINATION

RECOMMENDED BY: Minister of Sport, Culture and Heritage

ORDER

The objects listed are determined to be of cultural significance and the temporary exhibition or display of these works and objects in Manitoba by the Winnipeg Art Gallery – Qaumajuq is in the interest of the people of Manitoba.

AUTHORITY

The Foreign Cultural Objects Immunity from Seizure Act , C.C.S.M. c. F140, states:

Immunity from seizure of foreign cultural objects

1 When any work of art or other object of cultural significance from a foreign country is brought into Manitoba pursuant to an agreement between the foreign owner or custodian thereof and the Government of Manitoba or any cultural or educational institution, providing for the temporary exhibition or display thereof, in Manitoba by the Government of Manitoba or the cultural or educational institution, no proceeding or action shall be taken or permitted in any court and no judgment, decree or order shall be enforced in Manitoba for the purpose of, or having the effect of depriving the Government of Manitoba or the institution or any carrier engaged in transporting the work or object within Manitoba, of the custody or control thereof, if, before the work or object is brought into Manitoba the minister who is charged with the administration of this Act determines

(

a) that the work or object is of cultural significance; and

(

b) that the temporary exhibition or display thereof in Manitoba is in the interest of the people of Manitoba;

and the notice of the minister's determination is published in The Manitoba Gazette.

BACKGROUND

1. The Winnipeg Art Gallery - Qaumajuq is mounting the exhibition Tim Gardner: The Full Story and has entered into an agreement with the Whitney Museum of American Art in New York, NY to borrow the following artworks:

2. The objects will arrive and be on display from October 7, 2023 until April 7, 2024.

3. The Winnipeg Art Gallery - Qaumajuq has applied to the minister who is charged with the administration of this Act under

section 1 of the Act for a determination that these objects are of cultural significance and that the temporary exhibition or display thereof in Manitoba is of interest of the people of Manitoba.

ORDONNANCE

Les biens énumérés ci-après ont un caractère culturel et l’exposition temporaire de ces biens au Manitoba par la Winnipeg Art Gallery – Qaumajuq est dans l’intérêt de la population du Manitoba.

LOI FAISANT AUTORITÉ

La

Loi sur l’insaisissabilité des biens culturels étrangers, c. F140 de la C.P.L.M., stipule ce qui suit :

Insaisissabilité des biens culturels étrangers

1 Lorsque des œuvres d’art et d’autres biens à caractère culturel provenant de pays étrangers sont introduits au Manitoba pour des expositions temporaires, conformément à une entente entre leurs propriétaires ou gardiens et soit le gouvernement du Manitoba, soit une institution à caractère culturel ou éducationnel, aucune instance ni action ne peut être intentée ou autorisée, devant les tribunaux, et aucun jugement, décision ou ordonnance qui ôtent la garde et le contrôle de ces biens au gouvernement, à l’institution concernée et à ceux qui les transportent, ne peut être exécuté au Manitoba si, avant que ces biens ne soient introduits au Manitoba, le ministre chargé de l’application de la présente loi décide, à la fois :

(

a) que les biens revêtent un caractère culturel;

(

b) qu’ils sont temporairement exposés au Manitoba dans l’intérêt de la population.

Le ministre fait publier sa décision en ce sens dans la Gazette du Manitoba.

2. Les objets arriveront et seront exposés du 7 octobre 2023 au 7 avril 2024.

3. La Winnipeg Art Gallery – Qaumajuq a demandé au ministre chargé de l’application de la Loi en vertu de l’article 1 de ladite loi de rendre la décision que ces objets revêtent un caractère culturel et qu’ils sont temporairement exposés au Manitoba dans l’intérêt de la population du Manitoba.
